RESOLUTION

WHEREAS. House Pill 5A3b ~Clsapter 70-906} was passed by the

Florida State Legislature with an effective date of October 1, 1970; and
WHEREAS, said bill provided that any municipality in Pinellas County
is authorized and granted the power to install, improve and maintain water
or sewer lines and facilities outside of the boundaries of such municipality.
and to assess the abutting property so benefitted by such facilities when (1}
the municipality receives a petition requesting such service signed by at least
fifty per cent of the property owners within a given unincorporated geographic

area, or (Z1 when the Florida Division of Health shall officially notify the
municipality that a health hazard exists within a given uninaorporated geographic
area that is hazardous to the municipality as determined by a field survey
and appropriate teats of the State Division of Health; and
WHEREAS. the City of Clearwater has received a petition requesting
such service signed by over fifty per cent of the property owners within the
unincorporated geographic area of Oak Lane from Belleair Road North to
Price Circle and Price Circle from Oak Lane East and North to Nursery Road
fox those not already served by sewer service; and
WHEREAS, in accordance with said House Bi11 5d36 (Chapter 70-90b},
the City Commission passed Resolution No. 71-13 declaring its intention to
hold a public hearing to determine the need and necessity to construct sanitary
sewer lines and facilities in the unincorporated geographic area of Oak Lane
from Belleair Road North to Price Circle and Price Circle from Oak Lane East
and North to Nursery Road, in Pinellas County, Florida, on the 1st day of
March. 1971, at 1:30 P. M. in the City Hail Auditorium, l lZ S. Osceola Avenue,
Clearwater, Florida; and
WHEREAS, a notice of 1~earing was properly published and furnished

the City Engineer are directed to proceed with such improvements as an
assessment project and in accordance with the procedure as provided in
House Bill 543b (Chapter 70-906, passed by the Florida State Legislature,
with an effective date of October 1, 1970.
z. After completion of the construction of the sewex lines and
facilities, the City shall assess the actual cost thereof against the property
abutting said sewer lines and facilities and said costs shall be itemized and
subject to audit.
3. it is hereby determined at this public hearing that the price or
rate charged for the sewer service shah be no more than fifty per cent
{50°rr) higher than is charged for a like class of service to a like class of
users or consumers within the municipal boundaries of said City of
Clearwater.
