WHEREAS, the City of Clearwater, Florida, Tltc Philadelphia
National League Club, Inc. and the First National Bank of Clearwater
have executed a Construction Trust Fund Agreement dated November 3,
19bb; and
WHEREAS, Section 3 of the Agreement provides that requisitions
for payments shall be ~~duly executed on behalf of the Lessor by the City
Manager and the City Treasurer, or such other officers as the Lessor
shall by resolution duly appoint~~; and
WHEREAS, it has become apparent that the City Engineer is
supervising the construction on behalf of the City of Clearvratex on the
work site; and
WHEREAS, it would appear that the Gity Engineer;s name should
be added to the requisition farm and that all requisitions fox payments should
likewise have his signature thereon;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That all requisitions for payment under the Construction Trust
Fund Agreement dated November 3, 19bb, between the City of Clearwater,
Florida, The Philadelphia National League Club, J.nc. and the First National
Bank of Clearwater, be executed an behalf of the Lesser by the City Manager,
City Treasurer and the City Engineer and that no requisition for payment shall
be valid unless the signatures of all three officials of the City, as provided
aforesaid, be affixed.
2. That a certified copy of this Resolution be furnished the First
National Bank of Clearwater, Trustee, and The Philadelphia National League
Club, Inc.
