RESOLUTION

WHEREAS, tha City of Cleaxwater, Florida, a municipal cvrporatian,
has appliad to tha Housing and Urban Development Agency at the United States
o! Amarica for a grant of funds to be used in connection with financing a
water improvamont project of the City of Clearwater, Florida; and
WHEREAS, Section 402 of the Hauling and Urban Development Act
of 1965 sots Earth certain policy requirements to be followed by all parties
applying far such a grant of funds; and
WHEREAS, the City of Clearwater in connection with said proposed
projact is willing to abide by and fallow said policy provisions;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN 5ESSION DULY AND REGULARLY ASSEMBLED, AS
FDLLDWS:
Iti accordance with Section 40z of the Housing and Urban Development
Act of 1965, the City of Clearwater, Florida, hereby states and will satisfy
tha Agancy that:
1. It will make every reasonable effort tv acquire the real property
by negotiated purchase before instituting eminent domain proceedings.
2. It will not zequire any owner to surrender possession of real
property until the applicant pays, or causes to be paid, to the owner ta) the
agreed purchase pries arrived at by negotiation, or {b) in any Casa where
only tha amount of the payment to the owner is in disputa, not less than
seventy-five per cent ~75°fo~ of t}ie appraised fair value as agproved by the
applicant and concurred in by Housing and Urban Development Agency.
3. It will not require any person lawfully occupying property to
surrender possession without at least niatety t9oj days ~ written notice tram
the applicant of the date on which possession will be required.
4. The applicant will maintain records of its negotiations and other
actions, including reportu on all negotiations with property owners, ae
evidence of its adherence to this policy statement.
