WHEREAS, the City of Clearwatex desires an casement from the:
Atlantic Coast Line Railrnad Company fax constructing and maintaining a
street crossing at grade across tho right of way and tracks of said Railroad
at Myrtle Avenue, Clearwater, Florida, said crossing being 60 feet in width,
i. e. , 30 feet wide on each side of a line which extends across said right of
way in a north-south direction and intersects the center line of Coast Lines
main track at a point 2, 02q feet northeaetwardly measured along said center
line from A4ile Poat RE»BBI; and
WHEREAS, the City of Clearwater furthex agrees, upon completion
of said Myrtle Avenue crossing, to abandon and remove from said Railroad
Company's right of way the existing crossing of Cedar Street, located at
a point approximately 600 feet southwardly from the Myrtle Avenue crossing
described above, and to convey by Quit Claim Dead tv Coast Line the Cedar
Street right of way located within the limits of said Railrnad Company's main
track right of way; and
WHEREAS, the Railroad has prepared an Easement Agreement and a
Quit Claim Deed to that effect for formal execution by its corporate officers,
as well as the proper municipal officers of the City of Clearwater; and
WHEREAS, the Railroad has requested a Resolution be adapted by
said City, foxmally approving said agreement and quit claim deed and
authorizing the proper City officials to execute same;
NOW, THEREFORE, SE iT RESOLVED SY THE CITY
COMMLS5ION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the Mayor, together with the other appropriate municipal
officers of the City of Clearwater, are hereby authorized and empowexed to
'ki execute a certain Easement Agreement with the Atlantic Coast Line Railroad
Company, bearing date of September 8, 1965, and a certain Quit Claim Decd.
~f both in connection with the construction and maintenance of a street crossing
"' at grade across the right of way and tracks of said Railroad at Myrtle
Avenue, Clearwater, Florida.
2. That a certified copy of this Resolution be forwarded forthwith
to said Atlantic Coast Line Railroad Company.
PASSED AND ADOPTED this 18th day of October, 1965.
