RESOLUTION
No. 65 - 128
°
WHEREAS, the Atlantic Coast Line Railroad Company and the City'
of Clearwater, Florida, are agreeable to mutually undertake to install
flashing light signals at crossings of the new Myrtle Avenue, Z, 029 feet
North of Mile Post RE-881, Clearwater, Fioxida, as protection to the
traveling public; and
WHEREAS, it is understood between the Railroad and the City that
the Railroad will procure materials and install said signals by its forces
according to s#andard plans and specifications, put into sorvice and
thereafter bill the City for 100% of actual cost, including usual overhead
and cost of accounting, for which bill the City agrees to reimburse said
Railroad; and said Railxoad will thereafter operate and maintain said
signals at Railroad's expense; and
WHEREAS, the Railroad has prepared an agreement to that effect
for formal execution by its coxporate officers, as wall as the proper
municipal officers of the City of Clearwater; and
WHEREAS, the Railroad has requested a Resolution be adopted by
said City formally appxoving said agreement and authorizing the proper
City officials to execute same;
NOW, THEREFORE, SE IT RESOLVED BY THE CITY
COHiMLSSION OF THE CITY OF CLEARWATER, FLORIDA,
IN 5ESSION DULY AND REGULARLY ASSEMBLED, A5
FOLLOWS:
1. That the Mayor, together with the other appropriate municipal
officers of the City of Clearwater, are hereby authorized and empowered
to execute a certain Agreement with the Atlantic Coast Line Railroad
Company in connection with the installation of flashing light signals at
crossings of new Myrtle Avenue, 2, 029 feet north of Mile Post RE»881,
Clearwater, Florida.
2. That a certified copy of this Resolution be forwarded forthwith
to said Atlantic Coast Line Railroad Company.
PASSED AND ADOPTED this 18th day of October, 1965.
