90-28 .. ;.... .. .. ." e - OgSOLUTION NO. 90-28 A RESOLUTION OF THE CITY Cm...,ISSION OF THE CITY OF CLEARWATER, FLORIDA, DECLARING ITS INTENT TO MAKE CERTAIN PUBLIC IMPROVEMENTS, NAMELY THE CONSTRUCTION AND EXTENSION OF SIDEWALKS ALONG GULF BOULEVARD ON SAND KEY, PURSUANT TO CHAPTER 170, FLORIDA STATUTESj DETERMINING TO DEFRAY THE EXPENSE THEREOF BY SPECIAL ASSESSMENTS AGAINST THE PROPERTIES BENEFITTED BY THE IMPROVEMENTS; PROVIDING FOR THE MANNER IN WHICH SPECIAL ASSESSMENTS ARE TO BE MADE; DIRECTING THE CITY ENGINEER TO MAKE AND FILE WITH THE CITY CLERK A PRELIMINARY ASSESSMENT ROLL FOR THE PROJECT; PROVIDING FOR PUBLICATION. WHEREASt the City Commission of the City of Clearwater desires to install sidewalks in various locations along Gulf Boulevard on Sand Key as described more specifically herein, pursuant to the authority to perform such projects on a special assessment basis as set forth in Chapter 170t Florida Statutesj now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City Commission of the City of Clearwater, Floridat hereby declares its intent to proceed to install sidewalks in certain specified locations along Gulf Boulevard on Sand Key as described below, such improvements (referred to herein as the "project") to be conducted as a special assessment project. Section 2. The sidewalks shall be constructed in the right of way of Gulf Boulevard adjoining or adjacent to the following properties: Parcel Number 17/29/15/00000/330/0200: Upland and accreted land described as from the West right~of~way of Gulf Boulevard and the South section 1 ine run N 420 East, 28 feet to the POINT OF BEGINNING; thence" 480 West 963.18 feet; thence Northerly along the Mean High Water Line 475 feet; thence S 480 East 1170 feet to the West right~of-way line of Gulf Boulevard; thence S 420 West, 408.21 to the POINT OF BEGINNING. Parcel Number 17/29/15/00000/330/0210: Begin 28 feet North of the section line on the West right~of-way line of Gulf Boulevard; thence S 420 West 241.79 feet; thence N 480 West 849.21 feet to the Mean High Water Line and Point "A; II thence return to the POINT Of BEGINNING: thence N 480 West 963.18 feet to the Mean High Water Line: thence Southwesterly along said Mean High Water Line 267.31 feet to Point !lA.1I Parcel Number 19/29/15/00000/430/0100: Begin at the Northwest corner of Harbour Condo and the East right-of~way line of Gulf Boulevard: thence Northeasterly along said right-of~way line 630 feet to the Southwest corner of Sand Key Condo-South Bay (1501 Gulf Boulevard); thence S 670 East 96,52 feet: thence S 200 East 147 feetj thence S 690 East 180 feet; thence Southwesterly along the North line of Harbor Condo 234.69 feet to the POINT OF BEGINNING. Section 3. The assessment plat and plans and specifications for the project, as prepared and submitted by the City Engineer, are hereby adopted. Section 4. It is hereby determined that such project shall be constructed and the costs thereof shall be defrayed by special assessments upon the properties specially benefitted by the improvements, as described more particularly in Section 2 of this resolution, and that such assessments shall be levied on a front foot basis against the benefitted properties in direct proportion to the benefits received from the construction of the project. Section 5. The total estimated cost of such improvements is $15.650.13. No part of such cost shall be paid from the general improvement fund of the City, except that the City may contribute the cost of engineering plans and administration services for such project. Section 6. Such assessments shall be paid in not more than five (5) equal annual installments, with interest at the rate of ten (10) per cent per annum on the unpaid balance, from the date of acceptance by the City Commission of such project, to which, if not paid when due, there shall be added a penalty of one (1) per cent per month until paid: provided, that such assessments may be paid without interest at any time within thirty (30) days after the project is completed and a resolution accepting the project has been adopted by the City Connnission. Section 7. The City Engineer is hereby directed to make and file with the City Clerk a preliminary assessment roll showing lots and lands assessed and the amount of the benefit to and the assessment against each lot or parcel of land, and shall further show the number of annual installments in which the assessment is divided if not paid upon acceptance of the project. Section 8. The City Clerk shall cause this resolution to be published in full once a week for a period of two weeks in a newspaper of general circulation in the City of Clearwater and published in Pinellas County.
