89-06 ~ ~ " RESOLUTION NO. 89-6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, ASSESSING THE OWNERS OF PROPERTY THE COSTS OF HAVING MOWED OR CLEARED THE OWNER'S LOT. WHEREAS, it has becn determined by the City Commission 0" the City of Clearwater, Florida, through the enactment of Chapter 95 of the Colle of Ordintmces that, for the purpose of promoting the health, safety and general weltare of the citizens and residents of the City of Clearwater, real property within the corporate limits of the City such as described below should be cleared of weeds, rubbish, debris and other noxious material; and WHEREAS, notice pursuant to Section 95.07, Code of Ordinances, was provided to the owner of each of the lots ltsted below; and WHEREAS, the notice included notification to each property owner of the right to appear at a hearing before the Code Enforcement Board to show that the condition described in the notice did not exist or to show good cause why the condition should not be remedied by the City at the expense of the owner; and WHEREAS, the Code Enforcement Board has given each owner who elected to appear and protest the notice an opportunity to do so; and WHEREAS, the owners of each of the lots listed below either failed to appear and protest the notice or were informed by the Code Enforcement Board, after being heard, that the condition existed and should be remedied by the owner, but failed to take remedial action within the time allowed; NOW, THEREFORE, BE rr RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City Commission finds the preamble hereof to be true and correct, and further finds that the properties ltsted on Exhibit A, attached to this resolution and made a part hereof, were considered by the Code Enforcement Board at public hearings held on November 9 and December 14, 1988, and at the conclusion thereot the Board determined that the condition described in the notice to the ovmer should be remedied at the expense of the owner, but either It became necessary for the City to take remedial action or the owner took no corrective action untfl atter the time allowed. Section 2. Pursuant to Section 95.13, Code of Ordinances, the owner at each lot listed on Exhibit A has been provided with a notice and opportunity within which to pay the costs and administrative charges set forth on Exhibit A, but no payments have been received. -1- . . . .... ~ <,- , . . As to each parcel of renI property listed on Exhibit A, the City Commission, pursunnt to Sectlon 95.11, Code of Ordinances, hereby nssesses a lien on behalf of the City of Clearwater tor the actual costs of mowing or clearing, plm: administrative costs, 8S shown on Exhibit A. .. Sectlon 4. The City Clerk [s hereby directed to prepare a notice of lien agalmt each property listed on Exhibit A and to record the same [n the publlc records of PlneUas Comty, Florida. Section 5.
