RESOLUTION
No. 88 - 13
A RESOLUTION OF THE CITY COMMISSION OF
THS CITY OF CLEARWATER, FLORIDA, ASSES~
SING THE OWNERS OF PROPERTY THE COSTS OF
HAVING MOWED OR CLEARED THE OWNER'S LOT;
RESCINDING RESOLUTION 88-05 RELATING TO
SUCH COSTS.
WHEREAS, it has been determined by the City Commission of the City of
Clearwater, Florida, through the enaotment of Chapter 95 of the Code of
Ordinanoes that, for the purpose of promoting the health, safety and general
wolfare of the citizens and residents of the City of Clearwater, real property
within the oorporate limits of the City suoh as desoribed below should be
oleared of weeds. rubbish, debris and other noxious material; and
WHEREAS, notice pursuant to Seotion 95.07 of the Code of Ordinanoes was
provided to the owner of each of the lots listed below; and
WHEREAS, the notioe included notifioation to eaoh property owner of the
right to appear at a hearing before the Code Enforcement Board to show that
the oondition desoribed in the notice does not exist or to show good oause why
the oondition should not be remedied by the City at the expense of the owner;
and
WHEREAS, the Code Enforoement Board has given eaoh owner who eleoted to
appear and protest the notice an opportunity to do so; and
WHEREAS. the owners of eaoh of the lots listed below either failed to
appear and protest ,the notioe or were informed by the Code Enforoement Board,
after being heard, that the condition existed and should be remedied by the
owner, but failed to take remedial aotion within the time allowed;
NOH, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Seotion 1. The City Commission finds the preamble hereof to be true and
oorreot, and further finds that the properties listed on Exhibit A, attached
to this resolution and made a part hereof, were oonsidered by the Code
Enforoement Board at publio hearings held July 8, 1987, July 22, 1987, August
12, 1987, August 26, 1987, September 9, 1987. Oatober 14, 1987, Ootober 26,
1987. and November 18, 1987 and at the oonolusion thereof the Board determined
that the oondition desoribed in the notice to the owner should be remedied at
the expense of the owner, but either it beoame neoessary for the City to take
remedial action or the owner took no correotive aotion until after the time
allowed.

Seotion 2. Pursuant to Seotion 95.13 of tho Codo of Ordinanoes, tho owner
of eaoh lot listed on Exhibit A has been provided with a notioe and opportunity
within whioh to pay the oosts and administrative oharges set forth on Exhibit
,A, but no payments have boen reoeived.
,Seotion 3. ,As to eaoh parael of real property listed on Exhibit A. the
City Commission pursuant to Seotion 95.11 of the Code of Ordinanoes hereby
assesses a lien on behalf of the City of Clearwater for the aotual oosts of
mowing or olearing. plU3 administrative oosts, as shown on Exhibit A.
Seotion q. The City Clerk is hereby direoted to prepare a notioe of lien
against eaoh property listed on Exhibit A and to reoord the same in the public
reoords of Pinellas County, Florida.
Seotion~ The prinoipal amount of the liens assessed by this resolution
shall bear interest at the rate of ten peroent (10%) per annum from the date
of reoording of the notioe of lien until paid.

Seotion 6. Whereas Exhibit At attaohed to Resolution B8-05 was inoorreot,
we hereby resoind Resolution 66-05.
