A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
REQUESTING THE PINEJ~LAS COUNTY BOARD OF COUNTY
COMMISSIONERS TO CANCEL AND DISCHARGE CERTAIN TAX
LIENS UPON MUNICIPAL PROPERTY OWNED BY THE CITY,
KNOWN AS THE "FULTON STREET APARTMENTS" PROJECT,
WHICH JS USED FOR A PUBLIC PURPOSE, AND TO GRANT TAX
EXEMPTIONS; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Clearwatel', a Florida municipality, owns certain
hereinafter described t'eal property which is ututzed for a public purpose, specifically
as subsidized rental housing property for the purpose of providing snte,decent and
sanitary housing for persons of low income, pursuant to Florida ana federal law; and
WHEREAS, said property was leased to Better Clearwater Corporation, Inc., and
subleased to the Clearwater Housing Authority for such purpose; and
WHEREAS, certain terms in the lease agreem('.nt between the City and Better
Clearwater Corporation, Inc., have previously disqualified the property from tax
exempt statlE; and
WHEREAS, Better Clearwater Corporation, Inc., has been declared by the City
of Clearwater to be in default under its lease agreement by the adopUon of Resolution
88-10 on January 21, 1988, said Corporation has been involuntarily dissolved by the
State of FlorIda, and the City of Clearwater has terminated the lease agreement and
has retak('n possession of the property; and
WHEREAS, the terms of the lease agreement between the City and the
Corporation which disqualified the property from tax exempt status are of no further
force or effect; on1:1
WHEREAS, the property is in use for a public purpose which qualIfies for
eXi!mptton from od valorem property taxation pursuant to Section 196.28, Florida
Statutes; and
WHEREAS, the City of Clearwater desires that the Board of COlmty
Commissioners of Pinellas County discharge any and allliem for taxes held 01' owned
by the COWlty or the State ot Florida upon said property, and to further provide that.
" said property shall be exempt from County taxation so long us the same is owned and
used tor a proper pUblic purposo; and
WHEREAS, In order to comply with the policy of said board, the City or
Cleo.rwltter is willing to' guarantE.'6 payment of taxes prior to the effective date of the
termination ot the lease olJrCement between the City and Better Clearwater
Corporation, Inc., on the subject pl'operty when the tux rolls renect the proper amount
and th,e City Is billed tor that amotDlt; now, therefore,

Section 1. The City of Cl~rwater hereby requests the Board of COlmty
Commissioners of Pinellas County, Florida, to take all formal action necessary to
cancel and discharge any and all liens for taxes, held or owned by Plnellas County or
the State of Florida, upon property owned by the City of Clearwater and used for a
pUblic purpose, which property Is more particularly described In Exhibit A to this
resolution, from January 21, 1988, the effective date of the termination of the lease
a~ement between the City and Better Clearwater Corporation, Inc., and to provide
that said property shall be exempt from taxation so long llS the same is used for a
proper public purpose such as described hereinabove.
Section 2. The City of Clearwater guarantees payment of taxes prior to
January 21, 1988, the effective date of the termination of the lease agreement, when
the tax rolls renect the proper amolDlt and the City is bUled for that amolDlt.
Section 3. A certified copy of this resolution shall be delivered forthwith
following its adoption to the COlDlty Administrator for Plnellas County, Florida,
together with a certified copy of Resolution 88-10.
Section 4. This resolution shall take effect Immediately upon adoption.
PASSED AND ADOPTED this 21st day of January, 1988.
