No. 88 - 03
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA, ASSES-
SING THE OWNERS OF PROPERTY THE COSTS OF
HAVING MOWED OR CLEARED THE OWNER'S LOT.

WHEREAS, it has been determined by the City Commission of the City of
Clearwater, Florida, through the enaotment of Chapter 95 of the Code of
Ordinanoes that, for th~ plJrpose of promoting the healthl safety and general
welfare of the oitizens and residants of the City of Clearwater, real property
within the oorporate limits,of the City suoh as desoribed below should be
oleared of weeds, rubbish, debris and other noxious material; and
WHEREAS, notice pursuant to Section 95.07 of the Code of Ordinanoes was
provided to the owner of eaoh of the lots listed below; and
WHEREAS, the notioa inoluded notification to eaoh property owner of the
right to appear at a hearing before the Code Enforcement Board to show that
the condition desoribed in the notice does not exist or to show good oause why
tho condition should not be remedied by the City at the expense of the ownet';
and
\flIEHEAS, the Code Enforcement Board has given each owner who elected to
appear and protest the notice an opportunity to do SOj and
WHEREAS. the owners of eaoh of the lots listed below either falled to
appear and protest the notice or were informed by the Code Enforoement Board,
after being heard, that the oondition existed and should be remedied by the
owner, but failed to take remedial aotion within the time allowed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Seotion 1. TIle City Commission finds the preamble hereof to be true
oorreot, and further finds that the properties listed on Exhibit A, attaohed
to t,his resolution and made 11 part hereor, were considered by the Code
, ,
Enforcement Board at pub1io hearings held July 8, 1987, July 22, 1987. August
,'2, 1987, August 26, 1987, September 9, 1987, September 23, 1987 and Ootober
28, 1987, and at the oono1usion thereof the Board determined that the oondition
desoribed in the notioe to the owner should be remedied at the expense of the
,owner, but either it beoame neoessary for the City to take remedial aotion or
the owner took no oorrective aotion until after the time allowed.

Sootion 2.
Pursuant to Seotion 95.13 of tho Code of Ordinanoos, the owner
of each lot linted on Exhibit A hos been provided with a notioe and opportunity
within whioh to PBY the oosts and administrative oharges set forth on Exhibit
A, but no payments have been reoeivod.
Seotion 3.
As to eaoh parcel of real property listed on Exhibit A, the
City Commission pursuant to Seotion 95.11 of the Code of Ordinanoes hereby
assesses a lien on behalf of the City of Clearwater for the actual oosts of
mowing or olearing, plus administrative oosts, as shown on Exhibit A.
Seotion 4.
The City Clerk is hereby directed to prepare a notioe of lien
against eaoh property listed on Exhibit A and to reoord the same in the pUblio
reoords of Pinallas County, Florida.
Seotion 5.
The prinoipal amount of the liens assessed by this resolution
shall bear interest at the rate of ten peroent (10%) per annum from the date
, of reoording of the notioe of lien until paid.
Seotion 6.
This resolution shall take effeot immediately upon its
adoption.
