NO. 86-59
A RBSOLUTION OF THE CITY COMMISSION OF THE CITY OF
CLEARW ATBR, FLORIDA, AMENDING RESOLUTION 86-46,
WHICH FOUND AND DECLARED A BUILDING LOCATED AT
1003 RAILROAD AVENUE TO BE AN UNSAFE BUILDING,
ORDERED THE BUILDING REPAIRED OR DEMOLISHED, AND
ORDERED THAT THE COST OF DEMOLITION BE ASSESSED
AGAINST THE PROPERTY, IN ORDER TO CORRECT A
SCRIVENER'S ERROR IN THE LEGAL DESCRIPTION OF THE
PROPERTY; EXTENDING THE DEADLINE FOR COMPLIANCE
FROM AUGUST 16 TO SEPTEMBER 11, 1986; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission adopted Resolution 86-46 on July 17, 1986;
and
WHEREAS, Resolution 86-46 contained the legal description of certain real
property located in the City of Clearwater, the post office address of which is 1003
Railroad Avenue, upon which is located a building Which the Building Official has
determined to be unsafe, unsanitary, and unfit for human habitation; and
WHEREAS, the City Commission conducted a hearing on July 17~ 1986, upon the
recommendation of the BuUding Official that the building be demolished pursuant to
SecUon 138.02, Code of Ordinances; and
WHEREAS, at said hearing the owner appeared and objected to the entry of an
order to repair or demolish the buiIc}lngj and
WHEREAS, subsequent to the adoption of Resolution 86-46, the Building
Official dIscovered a scrivener's error in the legal description of the property, and
the City Commission desires to correct the error by the adoption of this Resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The first "whereas clause" in Resolution 86-46 is amended by
deleting the legal description set forth therein, and substituting the following:
North 75 feet of the South 1/2 of Block B, J. J. Eldridge's
Subdivision, according to the plat thereof as recorded in
Plat Book 1, Page 85, of the Public Records of
Hlllsborough County, Florida, of which Pinellas County
was formerly a part.
Section 2. Section 4 ot Resolution 86-46 Is amended to read:
Sectlon 4., If the occupant or owner fails to properly
comply with ResolutJon 86-46, as amt!nded by this resolution by 5 p.m. on
September 11, 1986, w*hlrl the said tl'tiftY ~91 day pefiedr the City Manager
shall proceed to cause the removal or demolition at said building

and shall charge upon those benefitted and the property such apeclal assessment
of the neoessary oostslncurred 8S determined by the City Commission and
shall provide that such assessment be alien upon the real
pruperty.
Section 3. This Resolution shall take eflect Immediately upon adoption.
