No. 86 - 57
A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTHORIZING THB MAYOR AND CITY CLERK TO EXECUTE AN
INSTRUMENT RELEASING AND TERMINATING CERTAIN DEED
RESTRICTIONS RELATING TO CERTAIN PROPERTY LOCATED
BETWEEN McMULLEN-BOOTH ROAD AND BA YSHORE
BOULEVARD, NORTH OF JOHN'S PARKWAY SUBDMSION, AS
DESCRIBED MORE PARTICULARLY HEREIN.
WHEREAS, Williams de Walker, Ltd., owners of most of the property described in
the Declaration of Restrictions recorded on August 25, 1972, at Official Records Book
3863, Page 842, of the Public Records of Pinel1as County, Florida, have obtained final
RPD Master Site Plan approval, subject to certain conditions, for their property; and
WHEREAS, the RPD Master Site Plan, subject to certain c'Jnditions, conforms
with current zoning requirements and does not exceed the density limitations set forth
In the Declaration of Restrictions; and
WHEREAS, the Restrictions cannot be terminated without the written consent of
the City of Clearwater after a public hearing has been held on the subject; and
WHEREAS, the City Commission has conducted a public hearing upon the request
of Williams de Walker, Ltd., to remove the Restrictions, and hIlS found and determined
that the Restrictions have served their purpose Bnd are no longer necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
!ection 1. For the reasons set forth in tho preamble to this resolution, the City
Commission finds and declares that it Is reasonable and in tha public interest to
consent to the release and termination of the Restrictions set forth in the Declaration
of Restrictions recol'ded at Offlclol Records Book 3863, Page 842, of the Public
Records of Plnellas County, Florida, and the Mayor and City Clerk are authorized to
execute 011 behalf of the City a Release and Termination of Restrictions, a copy of
w~ich Is attached to this resolution as Exhibit A, after having received Cully executed
Releases and Terminations of Restrictions from all ownel'S of the property SUbject to
the Declaration ot Restrictions.

Tho City Commission ot the City of Clearwater, Florida, having conduoted a
pubUo hearing on August 21, 1986, upon the request or WllUams & Walker, Ltd., to
remove the Restrlotlons set forth In the Declaration of Restriotions reoorded on
August 25, 19'12, at Official Records Book 3863, Page 842, of the PubUc Records of

PlneUas County, Florida, relating to the real property described therein, and having

authorized the Mayor and City Clerk to execute this instrument upon a finding that
the restrictions are no longer necessary and that it Is reasonable and In the public
interest to consent to the termination of said restrictions, does hereby release, remove
and terminate the restrictive covenants as set forth therein.
