RESOLUTION
No. 86 - 24
A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTE AN AGREEMENT WITH STATE OF FLORIDA DEPART-
MENT OF TRANSPORTATION AND SEABOARD SYSTEM RAIL-
ROAD, INC., FOR THE INSTALLATION AND MAINTENANCE
OF TRAFFIC CONTROL DEVICES ON A PORTION OF RAILROAD
RIGHT-OF-WAY WITHIN THE CITY, ON PENNSYLVANIA
AVENUE SOUTH OF ELDRIDGE STREET.
WHEREAS, the State of Florida Department of Transportation is
reconstructing or otherwise changing a portion of the State Highway
System, between Hart Street and Eldridge Street, which shall call
for the installation and maintenance of traffic control devices
for railroad grade crossings; and
WHEREAS, an appropriate agreement between the State of Florida
Department of Transportation, the Seaboard System Railroad, Inc.,
and the City has been prepared to effect the installati~~, and
maintenance of traffic control devices on Pennsylvania Avenue
South of Eldridge Street, within the city;
NON, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The Mayor and City Clerk are hereby authorized and
empowered to execute the agreement with the State of Florida Depart-
ment of Transportation and Seaboard System Railroad, Inc., a copy
of which is attached hereto as Exhibit A, for the purpose of
the installation and maintenance of traffic control devices across
a portion of railroad right-of-way, as described more particularly
in the agreement.
Section 2. This resolution shall take effect immediately upon
, adoption.
