No. 86 - 22
A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTnORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTE 'AN AGREEMENT WITH SEABOARD SYSTEM RAILROAD,
INC., FOR THm INSTALLATION AND MhINTENANCE BY THE
CITY OF A FENCE AND GATE ON A,PORTION OF RAILROAD
RIGHT-OF-WAY WITHIN THE CITY, EAST OF THE INTERSECTION
OF E STREET AND FIRST AVENUE WEST.
WHEREAS, the City of Clearwater has found it necessary to install
and maintain a fence and, gate across a portion of Seaboard System's
railroad right-of-way in order to restrict access to both the
railroad right-of-way and City owned property in order to curtail
illegal dumping which has occurred and which is likely to recur
unless the access is restricted; and
WHEREAS, an appropriate License Agreement permitting the City
to install the fence and gate has been prepared;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The Mayor and City Clerk are hereby authorized and
empowered to execute the agreement with Seaboard System Railroad,
Inc., a copy of which is attached hereto as Exhibit A, for the
purpose of permitting the City to install and maintain a fence and
gate across a portion of railroad right-of-way, as described more
particularly in the agreement.
pection 2. This resolution shall take effect immediately upon
adoption.
