^ RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTHORIZING HELICOPTER LANDINGS AS "SPECIAL EVENTS"
WITHIN THE OPEN SPACE/RECREATION DISTRICT UNDER
CERTAIN CIRCUMSTANCES.
WHEREAS, pursuant to Section 135.161, Code of. Ordinances, as
created by the Land Development Code, City Commission approval is
required for special events within the Open Space/Recreation District;
and
WHEREAS, under certain circumstances it is desirable to permit
the landing of helicopters on property having the Open Space/Recreation
District zoning, but it is impractical to require City Commission
approval for each heli~opter landing; and
WHEREAS, the City commission desires to permit helicopter
landings under certain circumstances as set forth in this
resolution, upon the approval of the City Manager or his designee;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN :SESSIOO DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. The landing of a helicopter upon property having the Open
Space/Recreation District zoning is hereby approved as a "special
event," provided that the City Manager or his designee shall approve
each helicopter landing in advance, and provided further that the
following requirements shall be met prior to the approval of any
such helicopter landing:
(1) Any person desiring to land a helicopter on property
having the Open Space/Recreation District zone shall
file an application for a helicopter landing permit
with the City Manager or his designee, which application

shall include the name and address of the sponsor of
the event; the date, time and location of the helicopter
,landing, and the estimated time of departure; the purpose
of the helicopter landing; and such other information as
the City Manager may require.

(2) The applicant shall obtain the approval by the Federal
Aviation Administration of the helicopter landing, and
shall furnish evidence of such approval to the City
Manager or his designee.
(3) The applicant shall furnish a certificate of insurance
demonstrating that the sponsor of the event is insured
against liability for bodily injury and property damage,
and showing that the City of Clearwater is an additional
insured. The insurance coverage shall be not less than
. $500,000 per person and $1,'000,000 per occurrence for
bodily injury, and $500,000 per occurrence for property
damage.
(4) The applicant shall execute, on behalf of the sponsor,
a hold harmless and indemnification agreement in favor
of the city in'a form approved by the City Attorney
and shall furnish evidence that the applicant is authorized
,to sign the agreement on behalf of the sponsor. The
agreement may be incorporated into the application form.
2. The approval by the City Manager or his designee of any
helicopter landing shall be for a specific site, date and time,
and the approval shall not be transferable to another site or
-another date.
'3. It is the intent of the City Commission to authorize the
. City Manager or his designee to approve helicopter landings on a
, one time basis only, and not upon any regularly scheduled or
recurring basis.
4. This resolution shall take effect immediately upon adoption.
