RESOLUTION

A,RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTHORIZING THER APPROPRIATE CITY OFF.ICIALS TO
EXECUTE AN AGREEMENT WITH SEABOARD SYSTEM RAILROAD,
INC., FOR THE INSTALLATION AND MAINTENANCE OF A
WATER PIPELINE WITHIN RAILROAD RIGHT-OF-WAY AT
GRANADA STREET, IN CLEARWATER, FLORIDA.
WHEREAS, the City of CleRrwater has found it necessary to install
and maintain, for the purpose of conducting water, a 6-inch PVC water
pipeline across the right-af-way and underneath the tracks of
Seaboard System Railroad, Inc.; and
WHEREAS, an appropriate agreement to that effect has been
prepared;
NOW, THEREFORE, BE',.! '1' RESOLVED BY 'rHE CITY
COMMISSION OF THE C(TY OF CLEARWATER, FLORIDA,
IN SESSION DULY ANDlkEGULARLY ASSEMBLED, AS
FOLLOWS:

1. That the Mayor and City Clerk are hereby authorized and

empowered to execute the agreement with the Seaboard System Railroad,
Inc., a copy of which is attached hereto as Exhibit A, for the
purpose of installing and maintaining a 6-inch PVC water pipeline
across the right-of-way and underneath the tracks of said Railroad,
at Granada Street, in Clearwater, Florida, as is more particularly
described in said agreement.
2. That this Resolution shall become effective immediately
upon its adoption.

any change or cancellation of the policy. All of these endorsements and
notice provisions shall be stated on the certificate of insurance which is to
be provided to the Licensor. Provided. however. that notwitastanding any of
the provisions of this agreement with respect to insurance. it is understood
and agreed that the liability assumed by the Licensee shall not be limited to
the insurance coverage stipulated herein.
It is understood and agreed that this agreement shall not be binding
until it has been authorized or ratified by a proper ordinance or resolution
of the City Council of the City of Clearwater, Florida, a certified copy of
which ordinance or resolution is attached hereto and made a part hereof.
IN WITNESS WHEREOF the parties hereto have executed this agreement in
duplicate the day and year first above written.
