No. 85-96
A RESOLUTION OF THE CITY OF CLBARWATBR~ FLORIDA,
REQUESTING THE PINELLAS COUNTY CONSTRUCTION
LICENSING BOARD TO REVIEW THE REQUIREMENTS IMPOSED
BY SECTION 161.55(l)(e), FLORIDA STATUTES, AS CREATED BY
CHAPTER 85-55, LAWS OF FLORIDA, RELATING TO THE ABILITY
OF A MAJOR STRUCTURE TO WITHSTAND A WIND VELOCITY OF
NO LESS THAN 140 MILES PER HOUR.
WHEREAS, the 1985 Florida Legislature created Section 161.55(1)(e), Florida
Statutes~ which requlres that major structures, except mobUe homes meeting certain
standards, shall be designed and constructed to withstand a wind velocity of no less
than 140 miles per hour up to a height of 30 feet above the average surrounding ground
level; and
WHEREAS, no guidelines have been established which are sufficiently clear to
enable the City of Clearwater's Building Official to verify that such a standard has
been met; and
WHEREAS, the 1985 enactment has created the passibility that new construction
after March 1, 1986, may be "overdesigned" and unnecessarily expensive, depending
upon the Interpretation to be given to the am endm ent;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY
AND REGULARLY ASSEMBLED, AS FOLLOWS:

1. The Pinellas County Construction Licensing Board is hereby requested to
take no action implementing the 140 mUes per hour criteria for construction prior to
tho mandatory implementation date of March 1, 1986.
2. 'I11e Plnellas County Construction Licensing Board is also requested to
create a technical committee to carefully review the law and its intent and determine
it that intent Is being met with Section 161.55(1)(e), Florida Statutes.
3. It the Pinellas County Construction Licensing Board detennines that the
neVi law will not meet the objectives of the Legislature, the Board is requested to
recommend changes to the law for consideration by the Florida Legislature to better
accomplish the protection of structures along the coast.
4. The Plnellas County Construction Licensing Board is further requested to
review Section 161.55(IXe), Florida Statutes, with the objective of establishing
uniform guidelines and standards necessary to Its enforcement and implementation,
and to recommend to the Florida Legislature such further amendments as the Board
may fInd reasonable and necessary.

m em ber. of the Plnella..CJ County Legislative Delegation.
8. This resolution shall take effect immediately upon passage.
