WHEREAS, it has been determined by the City Commission
of the City of Cloarwater, Florida, through the enaotment of Chapter
95 of the Code of Ordinanoes that for the purpose of promoting the
health. safety and general welfare of the oitizens and residents of
the City of Clearwater lots, paroels or traots of land within the
corporate limits of the City of Clearwater, Pinellas County, Florida,
suoh as desoribed below should be oleared of weeds, rubbish, debris
and otber noxious material; and
WHEREAS, notioe pursuant to Seotion 95.07 of the Code of
Ordinanoes was Provided to the owner of eaoh of the lots listed below
that such lot was 1n violation of Chapter 95, the Lot Clearing Code;

WHEREAS, pursuant to Section 95.07 of the Code of Ordinanoes,
following the determination that a violation exists, the property
wa~ postod requesting oomplianoe within fifteen (15) days; and
~tEREAS, notifioation was given to eaoh property owner advising
of the right to appear at a hearing before the Lot Clearing Board
to oontest the findings of violation and present evidenoe relating
to why such lot should not be oleared or mowed by the City; and
WHEREAS, tho Lot Clearing Board, pursuant to Seotion 95.09 of
the Code of Ordinanoes, has authorized eaoh of the lots listed below
to be oleared by the City and the aotual oosts of olearing or mowing,
plus administrative oosts, to be assessed against eaoh property owner;

'. That pursuant to Seotion 95.08 of the Code of Ordinanoes
the properties listod on Exhibit At attaohed to this Resolution and
made a part hereof; after notioe to each property owner, were
oonsidered by the Lot Clearing Board at a PUblio hearing held June
11, 1985 and Ausuat 13. 1985 with the question being should eaoh
lot be oleared or mowed by the Cit, and the oosts. inoluding
administrative oosts, assessed against eaoh property owner on the
list and following the hearing the Lot Clearina Board, pursuant to
Seotion 95.09 of the Code of Ordinanoes, authorized the City to olear
or mow aaoh lot.
2. That pursuant to Seotion 95.t3 of the Code of Ordinanoes
the owner of eaoh lot listed on Exhibit A has been prOVided with a
notioe and opportunity. thirty (30) days, within whioh to pay the
oosts and administrative oharges set forth on Exhibit A, but no
payments have been received.
3. That eaoh lot listed on Exhibit A. having been oleared or
m~wed by tho City pursuant to authorization by its Lot Clearing Board.
the City Commission pursuant to Seotion 95.t1 of the Code of
Ordinanoes hereby asses~es a lien on behalf of the City of Clearwater
against each paroel shown on Exhibit A for the aotual oosts of mowing
or olearing. plus administrative costs. as shown on Exhibit A.
4. That the City Clerk is hereby directed to prepare a notice
of 11en against eaoh property listed on Exhibit A and to file the
same in the offioe of the Clerk of the Cirouit Court of Pinellas
County. Florida.
5. That this Resolution shall beoome effeotive immediately upon
its adoption.
