OF CLEARWATER, FLORIDA, RELATING I}.'O THE CrI'Y

REPEALING SECTION 5 OF RESOLUTION NO. 79-23
IN ORDER TO DELETE THE REQUIREMENT THAT THE
CITY OF CLEARWATER HEALTH FACILI'UES AUTHORITY
SECURE THE ADOPTION OF A RESOLUTION BY T~E
CITY COMMISSION PRIOR TO I\U'l'HORIZING 1\NY BOND
FOR ANY PROJECT TO BE UNDERTAKEN BY THE AUTHORITY;
PROVIDING AN EFFECTIVE DATE.
\'lHEREl\S, the City Commission of the Ci l:y of Clear\'lnter
established the City of Clearwater Health Facilities Authority
by the adoption of Resolution No. 79-23 on AprilS, 1979; and
WHEREAS, Section 154.207, Florida Statutes, authorizes the
establishment of hcmlth f;'~cilities authorities by municipalities,

but does not require that th.:! governing body .,f a municipality
approve the issuance of bonds by a health facilities authority; and
WHEREAS, the City Commission of the City of Clearwater, Plorida,
finds that Section 5 of Resolution No. 79-23, requiring the approval
by the City Commission of bonds issued by the Health Facilities

Authority, is no longer necessary nor desirable;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
r'OLLOWS :

1. Section 5 of Resolution No. 79-23, as adopted by the City
Commission on April 5, 1979, is hereby repealed.
2, This Resolution shall take effect immediately upon
adoption.
PASSED AND ADOPTED this 17th day of October, 1985,
