RES 0 L UTI 0 N No . 85 - 68 A RESOLUTION OF TilE CI'l'Y OF CLEARWATER, FLORIDA, OPPOSING ANY LEGISLATIVE 1\'1'TEMPT TO REVERSE 'l'HE TRIANON DECISION OF THE FLORIDA SUPREME COURT, APRIL 4, 1985. WHEREAS, in Trianon Park Condominium Association v. City of Hialeah, No. 63,115 (Florida April 4, 1985), the Florida Supreme Court held that municipalities could not be subjected to tort liability for the failure of its building inspectors to adequately enforce the provisions of its building code; and WHEREAS, government cannot become the insuror of those injured when its laws and regulations are broken, or safety measures it imposes are ignored by others; and WHEREAS, common sense dictates that gover~ment cannot effectively promote the health, safety and welfare of the general public if it is exposed to this type of liability; and WHEREAS, the City Commission of the city of Clearwater firmly believes that there will be a substantial effort by certain parties to legislatively reverse the Trianon decision; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY 'ASSEMBI,ED, .AS FOLLOWS: 1. The City of Clearwater strongly opposes any legislative action that would reverse the Trianon decision. 2. The City of Clearwater strongly urges the Pinellas Coun~y Legislative Delegation to oppose any legislation that would reverse the Trianon decision. 3. A copy of this Resolution shall be sent to each member of the Pinellas County Legislative Delegation and each municipality in Pinellas County.
