I " .- J ~ ~ ,~ ,. .@ G RES 0 L UTI 0 N No. 85-67 A RESOLUTION REQUESTING THE FLORIDA LEGISLATURE TO RECOGNIZE THE EMERGENCY SITUATION OF LOCAL MUNICIPALITES DUE TO THE PRESENT HIGH COST OF OFFICIAL LIABILITY INSURANCE COVERAGE, AND URGING THE REESTABLISHMENT OF SOVEREIGN IMMUNITY AS A PRO'l'ECTION TO, 'l'IIE MUNIG.IPALITIES. WHEREAS, in recent weeks the availability of insurance has been reduced to an unacceptable level, and the cost of elected and appointed officials' liability insurance for Florida municipalities and local officials has increased to prohibitive costs; and WHEREAS, qual~fied people are discouraged from running for representative office'because of the continuous threat of suit in carrying out their normal duties~;, and WHEREAS, due to the excessive liability awards against municipalities and their elected and appointed officials~ and WHEREAS, the potential liability any municipality will face because of its inability to obtain the adequate official liability coverage; and WHEREAS, the amounts of these awards have rapidly increased to the point that any given judgment could render a municipality in serious financial difficulty and/or bankrupt, affecting the credit rating and financial stability of Florida's cities~ and WHEREAS, official liability insurance policies currently available in the market, at increased prices, have excluded some coverages necessary to carry out the normal function of local government~ and WHEREAS, the Florida Legislature has recognized this problem by exempting themselves from these risks of frivolous suits~ and WHEREAS, the City of Clearwater requests that local officials receive the same consideration and treatment afforded the members of the Florida Legislature~ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDJ\, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: .' -1- . That a copy of this Resolution shall be sent to each member of the Pinellas County Legislative Delegation and each municipality in PinalIas County. 3.
