A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER DECLARING A MORATORIUM
ON ISSUING PERMITS FOR 'I'HE ERECTION 01"
BILLBOARDS AND DIRECTING CITY OFFICIALS TO
IMPLEMENT THIS POLICY IMMEDIATELY.
WHEREAS, the City of Clearwater has announced its intention
to consider the adoption of a revised land development code,
including limitations on and amortization of billboards; and
WHEREAS, the City of Clearwater has observed several and
various persons interested. in erecting billboards have and are

coming, forward to request permits for the erection of billboards
which will become nonconforming if the proposed revised land
development code is adopted; and
WHEREAS, under the principles enunciated under Smith v. City
of Clearwater, 383 So. 2d 681, enables the City to take appropriate

steps to avoid a rash of nonconforming billboards;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSIION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

1. That the City Commission of the City of Clearwater hereby
, declares a moratorium on issuing permits for the erection of
, i
billboards which would become nonconforming upon the adoption of
the proposed revised land development code.
2. That this moratoriu~ will continue for so long as the City
of Clearwater actively considers adopting an ordinance regulating,
limiting or amortizing billboards.

3. That this Resolution shall become effective immediately
,upon its adoption and the appropriate City officials are directed
to immediately implement this policy.
