WHEnEAS, it has been determined by the City Commission
of the City of Clearwater, Florida, through the enaotment of Chapter
95 of the Code of Ordinanoes that for the purpose of promoting the
,
health, safety and general welfare of the oitizens and residents of
the City of Clearwater lots, paroels or traots of land within the
oorporate limits of the City of Clearwater, Pinellas County, Florida,
suoh as desoribed below should be cleared of weeds, rubbish, debris
and other noxious material; and
WH~REAS, notioe pursuant to Section 95.07 of the Code of
Ordinances was provided to the owner of each of the lots listed below
that such lot was in violation of Chapter 95, the Lot Clearing Code;
and
WHEREAS, pursuant to Section 95.07 of the Code of Ordinances,
fOllowing the determination that a violation exists, the property
was posted requesting oomplianoe within fifteen (15) days; and
WHEREAS. notification was given to eaoh property owner adVising
of the right to appear at a hearing before the Lot Clearing Board
to oontest the findings of violation and present evidence relating
to why such lot should not be cleared or mowed by the City; and
WHEREAS, the Lot Clearing BOQrd, pursuant to Section 95.09 of
the Code of Ordinanoes, has authorized each of the lots listed below
to be cleared by the City and the aotual costs of clearing or mowing,
plUS administrative oosts, to be assessed against each property owner;

1. That pursuant to Seotion 95.08 or the Colie of Ordinanoea
the propertios listed on Exhibit A, attaohod to th~s Resolution and
made a part heroorj aCter notioe to eaoh property owner, were
oonsidered by the ~ot Cloaring Board at a public hearing hold Ootober
9. 1984; November 13. 198~. and December 11. 198~
Hith the question being should each lot be oleared or mowed by,the
City and the costst inoluding administrative costs, assessed against
eaoh property owner on the list and following the hearing the Lot
Clearing Board, pursuant to Seotion 95.09 of the Code of Ordinanoes,
authorized the City to olear or mow each lot.
2. That pursuant to Section 95.13 of the Code of Ordinanoes
the owner of each lot listed on Exhibit A has been prOVided with a
notice and opportunity, thirty (30) days, "ithin whioh to pay the
oosts and administrative charges set forth on Exhibit At but no
payments have been reoeived.
3. That eaoh lot listed on Exhibit AI having been oleared or'
mowed by the City pursuant to authorization by its Lot Clearing Board,
the City Commission pursuant to Seotion 95.11 or the Code of
Ordinances hereby assesses a lien on behalf of the City of Clearwater
against each parcel shown on Exhibit A for the aotual costs of mowing
or clearing, plus administrative oosts, as shown on Exhibit A.
4. That the City Clerk is hereby directed to prepare a notice
of lien against each property listed on Exhibit A and to file the
same in the office of the Clerk of the Circuit Court of Pinellas
County, Florida.
5. That this Resolution shall become effective immediately upon
its adoption.
