RESOLUTION No. 85 -8 A RESOLUTION OF THE CITY COMMISSION OF THE 'I' CITY OF CLEAm'lATER,' FLORIDA, ASSESSING 'l'HE OWNERS OF'PROPERTY THE COSTS OF HAVING MOWED OR CLEARED THE OWNER'S LOT. WHEREAS, it has been determined by the City Commission of the City of Clearwater, Florida, through the enactment of Chapter 95 of the Code of Ordinances that for the purpose of promoting the health, safety and general welfare of the citizens and residents of the City of Clearwater lots, parcels or tracts of land within the coq:.orate limits of the City of Clear\~'a ter, P inellas County, Florida, such as described below should be cleared of weeds, rubbish, debris and other noxious material; and WHEREAS, notice pursuant to Section 95.07 of the Code of Ordinances was provided to the owner of each of the lots listed below that such lot was in violation of Chapter 95, the Lot Clearing Code; and WHEREAS, pursuant to Section 95.07 of the Code of Ordinances, following the determination that a violation exists, the p'roperty was posted requesting compliance within fifteen (15) days; and WHEREAS, notification was given to each property O\lner advising of the right to appear at a hearing before the Lot Clearing Board to contest the findings of violation and present evidence relating to why such lot should not be cleared or mowed by the City; and WHEREAS, the Lot Clearing Board, pursuant to Section 95.09 of the Code of Ordinances, has authorized each of the lots listed below to be cleared by the City and the actual costs of clearing or mowing, plus administrative costs, to be assessed against each property'owner; ,. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS r'OLLOWS: 1 . That pursuant to Section 95.08 of the Code of Ordinances the properties listed on Exhibit A, attached to this Resolution and made a part hereof, after notice to each property owner, were 60nsidercd by the Lot Clearing Board at a public hearing held October 9, 1984; October 23, 19841 November 13, 1984; 'and December 11, 1984, with the question being should each lot he cleared or Res. 85-8 1/2~/95 ----LI '. That each lot listed on Exhibit A, having been cleared or ~owed by the City pursuant to authorization by its Lot Clearing Board, the City Commission pursuant to Section 95.11 of the Code of Ordinances hereby assesses a lien on behalf of the City of Clearwater against each parcel shown on Exhibit A for the actual .. , . -.. , , , ~.
