A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER DETERMINING TO PROCEED
PURSUANT TO ARTICLE VIII, SECTION 2 (b),
FLORIDA CONSTITUTION, AS IMPLEMENTED BY
SECTION 166.411, FLORIDA STATUTES, AND
CHAPTERS 73 AND 74, FLORIDA STATUTES, TO
ACQUIRE THE REAL PROPERTY SET OUT BELOW
FOR RECREATION USE AND AS A RECREATION
COMPLEX.
WHEREAS, the City' of Clearwater, Florida, presently owns
land and a swimming pool located adjoining the property described
below which is devoted to recreation use: and
WHEREAS, ~he City Commission of the City of Clearwater desires
to acquire additional property for recreation use and a recreation

comlex that can serve a lar.ge area: and
WHEREAS, a public hearing was held by the city Commission
on September 6, 1984, wherein it was determined that acquisition
of the below tract and building located thereon would create a
recreation complex that could serve a large area and segment of
the population; and
WHEREAS, the property set out below has been appraised; and
WHEREAS, attempts to purchase the below tract have not met
with success; and
WHEREAS, Section 166.411, Florida Statutes, implementing
Article VIII, Section 2 (b), Florida Constitution, authorizes
the power of eminent domain for the above public purpose; and
WHEREAS, in order to acquire such land it will be necessary
to utilize the power of eminent domain;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission hereby determines that it is
necessary to utilize the power of eminent,dornain to acquire the
property set out below, such property being acquired to provide
additional land and building for an expanded' recreation complex
for recreation activities and programs for all citizens of the City
of Clearwater, Florida, and in particular
eastern sector of the City.

2. That the property to be acquired is more particularly
described as follows:
Being a portion of Lot 17 and Lot 24 of The
Pinellas Groves, Inc. as recorded in Plat Book 1,
page 55 of the Public Records of Pinellas County,
Florida, being situated in Section 19, Township
29 South, Range 16 East, Pinellas County, Florida,
and being more particularly described as follows:
Commence at the South property corner of Lot 234
of Morningside Estates, Unit 2, as recorded in Plat
Book 60, page 33 of the Public Records of Pinellas
County, Florida, and run S 44033'45" E, a distarice
of 60.0 feet to the P.O.B.; thence run ~ 44033'45"
E, a distance of 225.00 feet to a point; thence
run N 45026'15u E, a distance of 295.00 feet to a
point; thence run N 44033'45u W, a distance of
155.00 feet to a point; thence run westerly 110.11
feet to a point on the extended South right-of-way
line of Flushing Avenue, that is 210.0 feet north-
easterly of the intersection of Flushing Avenue
and Harn Boulevard as recorded in the aforementioned
subdivision; thence run S 45026'15u W along said
right-of-way and extension thereof, a distance of
210.0 feet to the P.O.B., containing 1.455 Acres,
more or less. SUBJECT TO: A Florida Power Corporation
easement as recorded in O.R. Book 2168, pages 276
thru 280, inClusive, and an existing 30.0 foot
right-of-way as recorded in Plat Book 1, page 55 of
the Public Records of Pinellas County, Florida.
3. That the City Commission hereby determines that the
interest to be acquired is a fee simple absolute estate.
4. That no conditions precedent remain to be performed
prior to the adoption of this Resolution.
5. That acquisition of the real property is necessary in order
to fully complete the expanded recreation complex created when
the above land is added to the recreation facilities already
located adjoining the site.
6. That the City Manager is hereby authorized to obtain a
survey of the land to be acquired on which the project will be
constructed.
7. 'fhat the City Attorney is hereby authorized to institute
necesoary eminent domain proceedings to acquire the land described
above.
8. That the City Manager is hereby authorized to deposit in
the Registry of the Circuit Court all monies necessary to complete
such eminent domain proceedings.
