A RESOLUTION OF THE CITY OF CLEARWATER REPEALING
RESOLUTION NO. 83-118; PROVIDING FOR A TWENTY-FIVE
CENT ($.25) FEE FOR EACH PARTICIPANT IN RACES USING
CITY STREETS AND RIGHTS-OF-WAY, SUCH FEE TO BE USED
TO DEFRAY THE COSTS OF ADMINISTERING AND PROVIDING
SUPERVISION FOR SUCH RACES; PROVIDING THAT THE CITY
MANAGER MAY REQUEST: A DEPOSIT FROM THE APPLICANT
BASED UPON THE ESTIMATED NUMBER OF PARTICIPANTS AND
PROVIDING FOR RETURN OF ANY SUMS OVERPAID THEREBY.
WHEREhS, the City commission passed Resolution No. 83-118 on
December 8, 1983, which provided for collectionof a fee for each
participant in races using City streets; and
WHEREAS, it has now become apparent that it is necessary to
provide for a deposit of the expected participation in order to
guarantee that the City will have the funds to defray the costs of
administering such races; and
WHEREAS, it is necessary to repeal said Resolution No. 83-118
and enact the following in order to provide for payment of the
costs of supervision, which costs are unbudgeted expenses for
several City departments;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
J.. That Resolution No. 83-11 8, which was passed by the City
Commission on December 8, 1983, is hereby repealed in ita entirety.
2. That the City Commission of the City of Clearwater, Florida,
hereby determines that a charge of Twenty-five Cents ($.25) per
participant shall be imposed on the applicant for special permit
to conduct a race utilizing in whole or in part public rights-of-
way located in Clearwater, Florida.
3. That the City Manager may require the applicant to pay said
charge as a deposit based upon the estimated number of participants
and may deny the permit if applicant refuses to pay such deposit.
4. That the charge set forth in Paragraph 1 shall be remitted by
the applicant within two (2) weeks following the race event, if a
deposit has not been required. If a deposit has been required, any
underpayment shall be remitted or any overpayment shall be returned
to the applicant within ten (10) days after receipt of the affidavit
provided for in Paragraph 5 hereof.

6. This Resolution shall become effective immediately upon
its passage.
