Dear Mr. Harvey:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installation
waiver for the property at 1215 N. Greenwood Avenue which is a corner lot at the
intersection of Engman Street.
Construction errors and plantings have narrowed the Engman Street right-of-way
available for sidewalk construction to a point where said sidewalk cannot be
reasonably installed. Since the absence of a sidewalk on this section of Engman
Street will not create a pedestrian hazard, a temporary waiver of the sidewalk
requirement is granted on the above-referenced property. Should it be determined
that a sidewalk is required at this location in the future, it will be installed
by the assessment process.

I have reviewed the request for a Sidewalk Wavier at 1215 N Greenwood. This is a
corner lot at the intersection of Engman Street. The sidewalk on Greenwood Avenue
is in place. The sidewalk on Engman is requested to be waived.
The distance between the curb line~of Engman Street and the property line is only
4~ feet according to the plans presented for the building permit. During the
construction of the parking lot the pavement was built wider than shown on the plan,
which resulted in the planter being located into the right-of-way. The remaining
strip of property adjacent to the curb is only one foot wide. In order to accomplish
the sidewalk installation it would be necessary to remove the planter and a portion
of the pavement to make the project conform to the plan. It is my belief that the
absence of this portion of sidewalk will not create undue hazard to pedestrians in the
area and that its presence will not justify the effort required to have a sidewalk
installed.
In the future the City may install it through assessment.

Section~8.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said s' ewalks.
