KNOW ALL ;\1EN BY THESE PRESENTS:
WHEREAS, Ordinance No. 1219 of the City of Clearwater requires
that all land that abuts a public right of way, which is to have new
construction on it, either for residential, commercial, industrial or
other purposes, shall have sidewalks constructed by the owner on,
across or adjacent thereto; and
WHEREAS, Brown Homes, Inc., is the Owner of the following described
real property situated in the City of Clearwater, Pinellas County,
Florida;
Lots 52 and 63, also the East 10 ft. of Lot 61 and the
West 15 ft. of Lot 64, Del Oro Groves Sub. (3310 San
Jose St.;
and
WHEREAS, on November 24, 1971, the City of Clearwater, Florida,
a municipal corporation, entered into an agreement with Brown Homes,
Inc., the Owner, which agreement was executed by the parties and
recorded in O.R. Book 3685, page 82 of the Public Records of Pinellas
County, Florida; and
WHEREAS, said agreement allowed the Owner not to install sidewalks
until a later date and Was to be regarded as a covenant running with
the land; and
WHEREAS, the Owner has now installed said improvements and has
complied with all of the provisions of said agreement, and the City
of Clearwater has accepted same;
NOW, THEREFORE, in accordance with the foregoing, the City of
Clearwater, Florida, a municipal corporation, does hereby release the
Owner of said above-described property from any of the terms and
provisions of said agreement and reque?ts.that said agreement be

be the individuals and officers described in and who executed the
foregoing Release and severally acknowledged the execution thereof to
be their free act and deed as such officers thereunto duly authorized;
and that the official seal of said municipal corporation is duly
affixed thereto, and the said agreement is the act and deed of said
corporation.
