D. 1971, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, here- inafter referred to as "City", and BELLEAIR H & S CORPORATION and BELLEAIR INVESTMENT CORP., INC., Florida corporations, hereinafter referred to as "Developers" ; WHEREAS, Developers are the owners in fee of that certain parcel of land described in Exhibit A, attached hereto, and are desirous of availing themselves of certain community services and annexation offered by the City of Clearwater; and WHEREAS, theis land is adjacent to the municipal limits of the City of Clearwater and the City is desirous of extending its services and jurisdiction into this area; and WHEREAS, it is mutua~ agreed between the City and the Developers that this land should be developed in keeping with the City's master plan for community development; WIT N E SSE T H: --------- NOW, THEREFORE, in consideration of the mutual covenants and promises as hereinafter set forth and the mutual benefits and obligations running between the parties hereto as hereinafter set forth, and for other good and valuable considerations, the parties hereto enter into the following agree- ments: 1. Developers sumbit herewith the following exhibits required by the City of Clearwater: a. Exhibit A. - Boundary Survey b. Exhibit B - Site Plan of initial development fronting on U.S. 19 demonstrating portions to be zoned "Business" c. Applicant's letter requesting annexation. 2. The property in the Site Plan to be zoned "Business" (approxi- mately 22 acres) shall be brought in for annexation and zoning in January, 1972, -1- Q(i-087'- I . !',",': , ' . . 3. Included in the survey and in addition to the Site Plan to be zoned "Business" (approximately 22 acres) are other properties which are con- tiguous to and lie Easterly of the Business property, approximating 38 acres, which will be brought in for annexation and zoning as a residential development at a density under thirty (30) units per acre, compatible with other developments in the same general area, i. e. Imperial Cove, Seville Apartments, etc., within three (3) years or sooner if development begins before that time. 4. Developers further agree that the residential units will be served for heating and water heating by gas and that gas cooking facilities shall be offered with electric to the purchaser. 5. Developers further agree to comply with all applicable Clearwater construction codes and ordinances, including landscaping, sign requirements, etc., and any other code or ordinance provisions of the City of Clearwater. 6. It is further agreed by the Developers that there will be a fifty foot right-of-way dedicated from U,S. 19 East to Tampa Bay for the ex- tension of Belleaire Street with a cul de sac turn-around area at the Bay, and that this cul de sac area will be included in the total area for the purpose of computing development density. Planting and landscaping to be by the City on said road. 7. Developers will provide all blanket easements as required by the City of Clearwater. 8. The City agrees that it will construct a lift station and force main on the shopping center complex on an easement to be provided at no cost to the City, of sufficient size and depth to serve not only the shopping center or business property, but apartment and residential units and other properties in the general area. The City's construction responsibility will stop at the lift station with all collection lines to be provided by the Developers. The City will construct a main water distribution line across the front or the rear of the shopping area as it deems advisable, sufficient in size to service the area. The parties hereto agree that this contract and the terms and conditions thereof shall be binding upon the successors, personal representatives and assigns thereof.
