THIS AGREEMENT, made and entered into this

MARY B. MUCKLER, his wife, owner s of Bayside Trailer Garden, 2991
Gulf to Bay Boulevard, Clearwater, Florida, and BILL KIRKPATRICK and
VIRGINIA KIRKPA TRICK, his wife, owners of Bay Breeze Trailer Park,
2975 Gulf to Bay Boulevard, Clearwater, Florida, hereinafter referred
to as "Owners", and CITY OF CLEAR WA TER, FLORIDA, a municipal
corporation, hereinafter referred to as "City";
WITNESSETH:
WHEREAS, the Owners have requested the City to barricade Rogers
Street to through traffic through their property for the safety of the residents
of Bayside Trailer Garden and Bay Breeze Trailer Park; and
WHEREAS, the City has determined that it is to the best interest
and advantage of the City and general public to do so;
NOW J THEREFORE, in consideration of the premises and for $1. 00
to each in hand, paid receipt of which is hereby acknowledged, and other
good and valuable considerations, it is agreed as follows:
1. The City of Clearwater will erect a barricade across Rogers
Street, 70 feet West of the East lot lines of Lots 4 and 15 of Wm. Brown's
Subdivision of Bay View, according to the map or plat thereof as recorded
in Plat Book 1, page 13 of the Public Records of Hillsborough County, Florida,
of which Pinellas County was formerly a part.
2. The Owners agree at their own expense to patch Rogers Street,
East of said barricade to the dead end of said RogersStreet andtorpaintain
same in a safe condition at all times. That the City Engineer shall be called
upon to make recommendations concerning the said patching and to approve
said work and his recommendations shall be final.

3. The aforesaid barricade erected by the City may be removed
at any time by the order of the City Commission.
4. This agreement shall be binding on the heirs, administrators,
personal representatives, successors and assigns of the parties hereto.

presents to be executed on the date first above written.
