~1 INTERLOCAL AGREEMENT I
THIS AGREEMENT is made and entered into this / Lt day of '11~,L./.>~/
1991, by and between Belleair Bluffs, a municipal corporation of the State of Florida,
hereinafter referred to as "Belleair Bluffs", and the City of Clearwater, a municipal corporation
of the State of Florida, hereinafter referred to as "Clearwater", as follows:
WIT N E SSE T H:
WHEREAS, all parties desire to provide for Library Services; and
WHEREAS, this Interlocal Agreement is authorized by the provisions of Section 163.01,
Florida Statutes, which authorizes the cooperative exercise by agreement of two or more public
agencies of any power common to them.
NOW, THEREFORE, in consideration of the covenants herein contained and other good
and valuable consideration, the CITIES agree as follows:
Section 1. CONDITIONS FOR AGREEMENT.
A. Clearwater will provide public library service to Belleair Bluffs residents having
certification of residency issued by Belleair Bluffs at any of the Clearwater' Library facilities.
At the time of execution of this Agreement and from time to time thereafter as necessary,
Belleair Bluffs will provide updated information for the Clearwater Library to know the
incorporated boundaries to determine BeIleair Bluffs residency.
B. Belleair Bluffs will pay 100% of the applicable nonresident library card fees for
Belleair Bluffs residents desiring Clearwater borrowing privileges. These fees are set forth in
Resolution Number 88-38 and incorporated herein by reference, which may be amended from
time to time.
C. Clearwater will notify Belleair Bluffs by August 15, 1992 of any nonresident library
user rate increase to become effective in fiscal year 1993 and will notify by August 15 of any
subsequent year that this agreement in effect. If no such notification occurs by August 15, the
then current rate shall remain in effect for the subsequent municipal fiscal year, October 1 -
September 30, without increase.
'D. BelleairBluffs residents using Clearwater Library cards will follow the circulation
policies of the Clearwater Public Library.
E. Belleair Bluffs will pay the cost of book courier service to and from a mutually
selected Belleair Bluffs site up to a maximum of five days per week on days that Clearwater is
regularly scheduled to have service. The cost of this service is calculated to be for Fiscal Year

F. Belleair Blurts twill provide and pay for the inStallaticf of an in-wall book return
designed to protect library materials and carrying bags at a mutually agreed location.
G. Clearwater will submit monthly bills for all cards issued to Belleair Bluffs residents
cards issued and for the book courier service. Belleair Bluffs will reimburse the City of
Clearwater within thirty days of receipt of the monthly bill. Any disputes in the bill will be
heard by the Director of Administrative Services for the City of Clearwater, whose decision shall
be final.
Section 2. EFFECTIVE DATE AND TERM. This Interlocal Agreement shall take
effect upon the execution by both parties to this Interlocal Agreement and filing with the Clerk
of the Circuit Court of Pinellas County, Florida. The initial term hereof shall be the 1991-92
fiscal year, ending on September 30, 1992.
Either party may request to re-negotiate or terminate this agreement at least thirty days
before the fiscal year concludes. The agreement will be automatically extended for another year
if no such action is taken.
Section 3. AMENDMENTS TO AGREEMENT. This Interlocal Agreement may be
amended, in writing, upon the express formal consent of the governing bodies of all the parties.
IN WITNESS WHEREOF, the parties to this Interlocal Agreement have caused their
names to .be affixed hereto by the proper officers thereof, as of the day and year first above
written.
