RESOLUTION FOR REDEVELOPMENT PLAN OF DOWNTOWN CLEARWATER '!: ."~-~.'. ~,~. . RESO~.N APloVING THE COMMUNITY REDEVELOP~T PLAN F' ~WNTOWN CLEARWATER PURSUANT TO THE PROVISIONS OF THEu(I)MMUNITY REDEVELOPMENT ACT OF 1969, CHAPTER 163, PART Ill, AND PREVIOUS RESOLUTION OF TIlE BOARD OF COUNTY OOMMISSIONERS DELEGATING AUTHORITY TO TIlE CITY OF CLEARWATER TO PREPARE SUCH PLAN AND RESERVING TO TIlE BOARD OF COUNTY OOMKISSIONERS AUTHORITY TO REVIEW AND APPROVE SAME; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Legislature of Florida enacted the Community Redevelopment Act of 1969, as amended; and WHEREAS, all powers arising through the aforesaid enactment were conferred ..liy thst enactment 1~pon counties with home rule charters, Which counties in turn are authorized to delegate such powers to municipalities within their boundaries . I When such ~nicipalities wish fO undertake redevelopment projects within their respective municipal boundaries; and WHEREAS, the City of Clearwater has previously petitioned Pinellas County to delegate by resolution the authority and powers under the act, as provided for in Section 163.410 F. S.; and WHEREAS, by resolution dated June 30, 1981, the Board of County Commissioners of Pine lIas County did so delegate the authority and powers conferred under Chapter 163, Part III, to the City of Clearwater as enumerated therein; and WHEREAS, paragraph 2 d. of, said resolution delegated to the ~ity the "power co prepare, adopt and modify the Redevelcpment Phn. subject to approval of the Board of County Commissioners of Pinellas County;" and WHEREAS, paragraph 3 a. of said resolution reserved to the Board of County 50 -'7/ I, , u<' - O~' (;; " Co' Commissioners the right of "...' rev~ew and approval of the initial Redevelopment ., Plan prior to its effectuation and ~lso prior to presentation to the Pinellas Planning Council;" and .~ . ... -., ~ WHEREAS, the City of Clearwater has prepared the Community Redevelopment Plan for Downtown Clearwater consistent with the provisions of Chapter 163, PART III F. S. and transmitted this Plan to the Board of County 'Commissioners for review and approval. That the loard of County Commiss10ners of Plnena.tunty approves (2) the Community Redevelopment Plan for Downtown Clearwater consistent with the provisions of Chapter 163, Part III, 'and the specific delegation of authority previously authorized by the County Com- mission; and (3) That the Board of County Commissioners of Pinellas County, in ap- proving such Redevelopment Plan, reserves all rights and prerogatives of the Board of CountyCCommissioners with respect to the independent IS II' review of and action ~n any matter that would otherwise come before 'rnll the Board in thenoraial,eourse of~their responsibilities and juris- :1(" \' diction within the downtown redevelopment area, including but not limited to the following areas: (a) Annexation and zoning as provided for under Chapter 171.062 F.
