AGREEMENT REGARDING USE OF ACL PARKING LOT # .. ~ I I AGREEMENT This is an agreement between the Bank of Clearwater and the City of Clearwater in regard to the use of the ACL Parking Lot during the construction of the new bank building at Garden Avenue and Cleveland Street. The Bank of Clearwater or its contractor will be responsible for the following: 1. Cut and pave an opening in the meter walk as designated by the Traffic Engineer. 2. Construct driveways as needed and approved by the City Engineer to serve the site from Cleveland Street and Garden Avenue and to restore sidewalk upon completion of construction. 3. Relocate storm sewer as designated by the City Engineer. 4. Construct pedestrian protection on Cleveland Street sidewalk. 5. Build wood rail barricade separating portion of parking lot used by the contractor from remainder of the parking lot. 6. Rebuild planters at Cleveland Street end of the lot to City specifications. 7. Maintain at least 24' of open street on Garden Avenue; assume cost of off-duty officer to direct traffic if problems result from construction activity. 9. Install and maintain lights on all barricades. 10. Replace in kind any pavement, sidewalks, etc., damaged during construction. 11. Reimburse the City in the amount of $100 per month for use of the lot and loss of meter revenue.
