ADOPT-A-PARK AGREEMENT

THIS AGREEMENT is made and entered into_this
7th day of August
1986
by and between the City of ClearwAter, a mUllicipal corporation, hereinafter
referred to as CITY, and Barnett Bank, hereinafter referred to as DONOR. '
WHEREAS, CITY has instituted an Adopt-A-Park program to encourage and
obtain support from civic-minded entities and individuals for the maintenance of
CITY parks; and
WHEREAS, such maintenance would promote the general welfare by aestheti-
cally improving said parks and enhancing their use; and
WHEREAS, DONOR desires to adopt the Clearwater Beach Triangle shown on
the attached aerial;
NOW, THEREFORE, the parties hereto agree as follows: ,
1. CITY shall have landscaping in place approximately by December 30,
1986 according to a landscLlping plan submitted by Michael Mulligan,
City Landscape Architect.
2. CITY shall assume responsibility for replacement of any dead or
damaged plants for a five (5) year period, maintaining planted
materials according to original design.
3. CITY shall provide spraying, irrigation, flowering annuals on a
rotation basis and annual re-mulching.
4.- DONOR shall provide mowing, weeding, edging, pruning, fertilizing
and other care necessary to maintain healthy plants.
5. DONOR shall.construct and provide a sign approximately 18" tall
by 4' wide which will state that maintenance is performed by
Barnett Bank. The design of said sign will first be submitted
for City approval. It will be installed by the City and main-
tained by the donor.
6. DONOR and, CITY agree that Barnett Bank has the right to disco~tinue
maintenance in the event the City does not maintain the planted
materials accbrding to original design. Also, the CITY has the
right to remove the sign and cancel this Agreement in the event
DONOR does not provide regular maintenance necessary for healthy
and attractive plantings.
7. This Agreement shall terminate on ,August 7, 1991
unless renewed by the written mutual consent of the parties at
least' 3P days prior to its expiration and the expiration of any
extensions thereof.
