Dear Mr. Granese:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installation
waiver for the above-referenced property.
The above-referenced property does not meet the requirements as set forth in the
aforementioned Code, paragraph (e). Since the sidewalks in question will connect
to an existing sidewalk on Drew Street, the requirements for a waiver are not
met, and I cannot grant a temporary waiver of the sidewalk installation
requirement on the above-referenced property. Therefore, your request is denied.

REASON FOR REQUEST 1) The sidewalks on the West side of Greenwood Avenue
will serve no purpose because there is a sidewalk system along Greenwood
Avenue on the East side of the street, from Cleveland Street to Seminole
Street. A sidewalk along Greenwood Avenue on my property would be the only.
sidewalk along the West side of Greenwood Avenue and would serve no purpose.
There is no sidewalk on the West side of Greenwood Avenue either North or
South of my property. 2) I understand that this waiver means that the
City retains the right to install sidewalks at a future date.
Section~8.09 of the Code of Ordinances of the City requ~res that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial,. industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.
