WHEREAS, the owner of the property described herein understands that the
waiver granted herein is only temporary in character and that this agreement must
provide a reasonable period of time for the waiver to be effective;
NOW, THEREFORE, in consideration of the foregoing premises and other
good and valuable consideration between the parties, receipt of which is hereby

1. The City in light of the facts found as set forth in Exhibit A attached
hereto and made a part 'herein as ~ folly rewritten, grants to the Owner a tem.porary
waiver of the sidewalk installation requirement i.J::nposed by Section 7 -6 of the Code
of Orciinances of the City of Clearwater.

is removed or otherwise changed.

set out in Exhibit A which presently exists on the property and which was sufficient

relates to sidewalk installation.

accordance with City .pecifica.~ons and standards within ninety (90) days from the
notifica.tion by the City, ti1en the City may have t.1:le sidewalks installeda.nd assess
and iInpoee a lien 'against the d~scribed real property for the cost of the work.
5. This agreement is to be regarded a.s a covenant :t'I1'n'ni'ng with the land
regardles a of whetber it is specifically mentioned in any deeds or conveyance sub-
sequently executed. and this agreement sh~ll be binding on ill parties, the heirs,
personal representatives, successors or assigns:

In response to a request from Mr. and Mrs. Albert F. Lipp for a
waiver of requi rement for installation of a sidewalk at the
subj ect propert y in conj unct ion with new const ruct ion as requi red
by City Ordinance, I have examined this property and the following
are my findings:
l. There are no sidewalks within 200 feet of the property~ and
thi s is the last lot to be developed in this area.
2. A si dewa1 k on thi s p rope rt y, at thi s time, waul d not fo rm
a part of a rout e leadi ng to a school.
3. The absence of such a sidewalk would not present a pedestrian
hazard.
In my judgement the above findings meet the conditions prescribed in
Ordi nance l624~ Sect ion 1, Paragraph (4)(a) and ther e fore a waiver
of inst a11at ion of a si dewal k at thi s time i~t~~_i'ed.
