Dear Mr. Rogero:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installation
waiver for the above-referenced property.
The above-referenced property does not meet the requirements as set forth in the
aforementioned Code, paragraph (e). Since the existing sidewalk along Gould
Street is within 200 feet of the property at 1150 Gould Street, the requirements
for a waiver are not met. Therefore, I cannot grant a temporary waiver of the
sidewalk installation requirement and your request is denied. Sidewalks are
required along both the Gould Street and the Madison Avenue frontages.

This property is located on the northeast corner of Madison Avenue and Gould Street. When
the property on the northwest corner was developed for commercial use, sidewalk was
installed along Gould and along Madison.
Since the existing sidewalk along Gould is within 200 feet of the property at 1150 Gould,
the requirements for a waiver are not met, and sidewalk should be required along both the
~Uld Street and Madison Avenue frontages.

Section~8.09 of the Code of Ordinances of the City requires that all land
that abuts a pubric right-of-way, which is to have new construction on it,
either for residential, co~~ercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.
