MEMORANDUM TRUST AGREEMENT
MEMORIAL MONUMENT - MABEL H. :KRUSE
WHEREAS, Arthur M. Kruse has directed the Mut-
ual Benefit Life Insurance Company of Newark, New
Jersey to pay one-third (1/3) of the proceeds at
maturity, of their Policy No. 1,627,925 to the City
Treasurer of the City of Clearwater, Florida, as trustee
for the use and benefit of the Memorial Civic Center
on Clearwater Beach, and to be expended for a decora-
tive and/or drinking fountain of appropriate design
to serve as a memorial to Mabel H. Kruse, deceased,
wife of the insured; and,
WHEREAS, the City of Clearwater, by and through
its City Manager, did on June 9, 1959, approve the terms
and conditions set forth above; and,
WHEREAS, the City of Clearwater has been requested
to execute a trust agreement accepting and agreeing to
perform pursuant to the terms of said trust by install-
ing a decorative and/or drinking fountain to serve as
said memorial to Mabel H. Kruse, the deceased wife of
Arthur M. Kruse; in Memorial Civic Center, Clearwater Beach.
NOW, THEREFORE, in consideration of the sum of One
Dollar-and other-good and -valuable consid~iations, the
City of Clearwater does ~ereby expressly agree to perform
under and by virtue of this trust agreement upon receipt
of said proceeds, in accordance with the conditions set
forth in Policy No. 1,627,925 of Mutual Benefit Life In-
surance Company of Newark, New Jersey, and further agrees

to maintain said memorial when, as and if the pro-
ceeds of this trust are received by the said City
and said memorial is constructed and completed in
the Memorial Civic Center on Clearwater Beach, pro-
vided said center is erected by the City of Clear-
water.
