Surety or Obligee; except that if such contract provides for a maintenance or guarantee period any such suit, action or proceeding may be brought within six (6) months from the expiration of such maintenance or guarantee period but not afterwards, It is expressly understood that the penal stun of this bond shall be reduced by and to the extent of any payment or payments made by the Surety.
