Re: Code Enforcement Board Representation
Dear Pam:
I am writing in regards to fees charged for representation for the Municipal Code
Enforcement Board. I believe that our firm is currently charging the City of Clearwater at a rate
of $125.00 per hour for all matters other than representation of the Code Enforcement Board.
It is my understanding that charges for the Code Enforcement Board should be at the same rate
as for all other services provided by this firm. If I am incorrect or have misunderstood the
arrangement between our firm and the City, please contact me at your convenience to discuss.

Dear Mr. Galbraith
We are pleased to provide you with the terms and conditions
for our representation of the City of Clearwater's Code
Enforcement Board. Our representation would include all work
necessary to advise the Board. Thus, we would attend all Board
meetings, advise the Board's Secretary with regard to procedural
and other matters arising prior to and after hearings, draft
Orders and other documents for the Board, advise the Board on all
legal issues arising during its hearings, including the conduct
of those hearings, advise Board members regarding conflicts of
interest, Sunshine Law and Public Record Law issues, handle
foreclosure actions, if requested and represent the Board with
regard to any other matters requested. I will be in charge of
the firm's representation of the Board.
We suggest an hourly rate for these services of $85 per
hour. These rates are subject to change. If such a change
occurs, we will advise you of our new rates, which will apply to
all subsequent undertakings.
We want you to be satisfied not only with the quality of our
services, but also with the reasonableness of the fees that we
charge for those services. Therefore, we will attempt to provide

as much billing information as you require, and we would be more
than happy to discuss with you any billing format that you would
,desire. In addition, we hope you will feel free to discuss
questions concerning our fees on any particular matter. It is my
understanding that the City's contact people will be the City
Clerk and the Board's Chairperson. Our bills will be addressed
to the City Clerk.
Statements are generally rendered on a monthly basis. Each
statement will set out in detail the services which have been
performed and the nature of the costs which have been incurred on
your behalf. Unless you have made written arrangements to the
contrary, each such statement is payable upon receipt.
Any dispute which may arise in the course of this
engagement, either over the quality or quantity of services
provided, over the amount of the fee, or over the non-payment of
the fee, shall be submitted to binding arbitration. The
provisions of the Florida Arbitration Code, Chapter 682, Florida
Statutes, shall control. We hereby agree to the submission of
any dispute to binding arbitration; you, by signing and returning
a copy of this letter, agree on behalf of the City to the same
provision. Should payment of any of our statements not be
received on or before the last day of the month in which the
statement is generated, we will then charge interest on the
outstanding balance at the rate of one and one-half percent (1-
1/2%) per month or eighteen percent (18%) per annum.
The above prov~s~ons outline in reasonable detail our
agreement as to this representation. If you have any questions
about the contents of this letter or other terms and conditions
of our engagement, please let me know. If the arrangements
described in this letter are satisfactory, please date and sign
the enclosed copy of this letter and return it to me in the
enclosed, addressed envelope.
