STATEMENT OF SEWER CHARGES TO BE PAID FOR ITS WATER CONSUMPTION FOR SELF-OWNED WATER - A-OK INDUSTRIES INC. 4- #. "" / =.-~- .~ - J STATEMENT OF SEWER CHARGES TO BE PAID BY A-OK INDUSTRIES, INC., d/b/a SKYCREST CAR WASH OF ITS WATER CONSUMPTION FRS ,}., THIS STATEMENT is made this da y of ~c__~ (0 ~--, ~ , 1979, by the CITY OF CLEARWATER, FLORIDA, a municipal corporation, (hereinafter, "City"). A-OK INDUSTRIES, INC., a Florida corporation, (herein- after, IIA-OK"), although not technically a party to this statement, acknowledges the contents of this statement as accurate. WITNESSETH THAT: WHEREAS, A-OK is the owner of a commercial car wash business known as Skycre st Car Wash (hereinafter, IISkycre st"), located at 1880 Gulf-to- Bay Boulevard, in 1he City of Clearwater, Florida; and, WHEREAS, City operates a sanitary sewer system to which Skycrest is pre sently connected; and, WHEREAS, A-OK has installed a self-contained water reclamation unit at Skycrest which recycles water used in its car wash business; and, WHEREAS, while such reclamation unit is in operation, no waste water from the car wash business enters into City's sanitary sewer system; and, WHEREAS, A-OK recognizes that, as in all mechanical operations, there may be periods when the reclamation unit Will be temporarily out of operation; and, WHEREAS, A-OK further recognizes that during such periods of interruption in the operation of the reclamation unit, it must utilize the City's sanitary sewer system to dispose of water from its car wash business; and, WHEREAS, A-OK provides water for the car wash business from its own well; and, WHEREAS, the City cannot install a meter on the said sewer line to monitor the flow of wastewater through itbecause said line operates on a gravity flow principle and the cost would be prohibitive, but can install a water meter on the reclamation system near the City sewer; and, WHEREAS, this Statement establishes the procedure for billing A-OK for its temporary use of the City sewer system, as provided for in Ordinance 1822, which permits the City to meter water consumption for sewer customers using non-City owned water. <,~ -1- 01 -CfJ0-rB (~7)- 1 ,- :;; ,J - r(i -----------,A .~~ , , NOW, THEREFORE, A-OK shall do as follows: 1. A-OK shall purchase and install at its expense a gate valve with a breakable seal at the entrance to City's sewer main serving Skycrest. A-OK shall notify the City immediately upon its installation. City reserves the right to inspect the valve to insure its proper installation. The City shall seal this valve at A-OK' s expense. 2. In the event of a breakdown of its reclamation uni t or other emergency, A-OK is authorized to break the seal on said gate valve and to dispo se of the wastewater from its car wash business into City1s sewer system. A-OK shall immediately notify City's Utility Department of the exact time of breaking the seal. 3. The City shall install a 1-1/2" water meter, at no expense to A-OK, at a point on A-OK' s reclamation unit as near as possible to the City's sewer system. The final determination of its placement is to be made by the City. 4. Said meter shall monitor the flow of A-OK' s wastewater into the City's sewer system should said gate valve not be sealed or the seal subsequently broken. During this period of actual usage of the City's sewer system, per City Code Sections 17-8(2) and 24-28(b) (rates subject to Code arne ndment), A-OK's sewer rate shall be 160% of total of $81. 15 (the minimum monthly water charge for a 1-1/211 water meter) plus $0.63 per 100 cu. ft. of water used over the 20,000 cu. ft. per month allowance, prorated to the day during this period. 5. In any event, A-OK shall pay the City the minimum, monthly sewer charge (as amended from time to time) established by Section 17-8(2), Clearwater Code of Ordinances, presently $4.25 per month. 6. Upon termination of temporary use of City's sewer system, A-OK shall notify the City's Utility Department immediately, whereupon further charges for such use shall terminate, except for the minimum monthly sewer charge as stated in Paragraph 3 above. City shall reseal the gate valve at A-OK's expense. The charge for such reconnection shall be the rate charged City's customers from time to time for water service charge. The current rate is $5.00 per service call. City shall have the right to reinspect the resealed valve from time -2- ~ ..: :' -~~~ I to time. " , 7. If A-OK breaks the seal en the gate valve and thereafter fails to notify the City to reseal the same, the City will bill at the consumption shown on the water meter from the previous reading period.
