The purpose of this application is to rollover certain funds from the 3rd year
Community Development Block Grant Program into the 4th program year. This will
facilitate the completion of both the Utility and Street Improvement Project in
South Greenwood. and the Coin Laundry Building at Condon Gardens - both were
funded and approved as 3rd year activities; however, projected construction costs
will not permit their completion without additional funding from the 4th year
budget. The City Connnission authorized this amendment procedure during a Public
Hearing on January 18, 1979.

The purpose of this application is to expand the budget of the 4th year Community
Development Block Grant Program with funds rolledover from the 3rd Program Year.
This will facilitate the completion of both the Utility and Street Improvement
Project in South Greenwood and the Coin Laundry Building at Condon Gardens - both
were funded and approved as 3rd year activities; however, projected construction
costs will not permit their completion without additional funding from the 4th year
budget. 'The City Commission authorized this amendment procedure during a Public
Hearing on January 18, 1979. Durina this same hearing they reallocated funding
for the Swimming Pool Project that was to serve the Wood Valley/Condon Gardens Area
of Clearwater.

The following activities are the product of an active commitment by the
City Commission to provide certain capital improvements to support an
ongoing program of neighborhood preservation and revitalization. The
accomplishment of these activities is urged by committee members of the
developing Clearwater Neighborhood Housing Services, Incorporated (an
organization sponsored by the Urban Reinvestment Task Force). The
current projects include:

1. Upgrading Scranton, Tilley and Ewing Avenues from dirt to asphalt pavement
with concrete curbs and gutters; rebuilding Woodlawn and Greenwood Avenues
~o City standards.
2. Extending the existing sanitary sewer collection system to serve South
~tle Avenue, portions of Howard Street, South Washington and South
Michigan Avenues, and to hook-up existing residential structures to this
system; replacing existing sanitary sewer collection systems on Scranton,
Tilley, Ewing, Tioga, South Washington, South Madison, South Michigan,
South Greenwood and Woodlawn Avenues, Howard and Vernon Streets.
Note: existing pavement damaged by this construction will be repaired.
3. Construction of an adequate storm sewer collection system along Be11eair
Road, Woodlawn and South Greenwood Avenues. Special outfall structures
and swales will be constructed to prevent siltation. of Lake Bellevue.
The above projects were funded as multi-year projects under Grant
Number B-77-MC-12-QOO2 and B-78-MC-12-0002; however, all will be completed
during FY '79.
The City Commission has contracted with the Urban Reinvestment Task Force to
reserve $75,000 to provide funds for a ''high risk" loan fund to assist
qualifying. NHS residents in the financing of housing rehabilitation in the
neighborhood. This program will supplement the existing City Rehabilitation
Program.

(12 spaces).
3. Construct 900 lineal feet of "french drains" to dry-up ponding areas
along sidewalks ~nd entrances into buildings. Currently water stands in
sheets until it evaporates after a rainfall, and residents either walk in
mud or wade in water standing on sidewalks.

Assurances
The applicant hereby assures and certifies that:
(a) It possesses legal authority to apply for the grant, and to execute the
proposed program.
(b) Its governing body has dUly adopted or passed as an official act a reso-
lution, motion or similar action authorizing the filing of the application,
including all understandings And assurances contained therein, and directing and
authorizing the person identified as the official representative of the applicant
to act in connection with the application and to provide such additional informa-
tion as may be required.
(c) It has complied with all the requireme~ts of OMB Circular No. A-95 as
modified by 24 CFR 570.310 and that either:
(1) Any comments and recommendations made by or through clearinghouses are
attached and have been considered prior to submission of the application~ or
(2) The required procedures have been followed and no comments or recommenda-
tions have been received.
(d) Prior to submission of its application, the applicant has:
(1) Prepared a written citizen partiCipation plan, which:
(i) Provides an opportunity. for citizens to participate in the development
of the application, encourages the submission of views and proposals, particularly
by residents of blighted neighborhoods and citizens of low- and moderate-income,
provides for timely responses to the proposals SUbmitted, and schedules hearings
at times and locations which permit broad participation~.
(ii) Provides citizens with adequate information concerning the amount of
funds available for proPosed community development and housing activities, the
range of activities that may be undertaken, and other important program reguire-
ments~ .
(iii) Provides for public hearings to obtain the views of cit1zens on commu-
nity development and housing needs~ and
(iv) Provides citizens with an opportunity to submit comments concerning the
community develop~ent performance of the applicant.
. (2) Followed this plan in a manner to achieve full participation of citizens
1n development of the application. The applicant shall also follow this plan to
achieve full citizen partiCipation in all other stages of the program.
(e) Its chief executive officer or other officer of applicant approved by
BUD:
(1) Consents to assume the status of a responsible Federal official under the
National Environmental Policy Act of 1969 insofar as the proviSions of such Act
apply to 24 CFR 570f
(2) Is authorized and consents on behalf of the applicant and himself to
accept the jurisdiction of the Federal courts for the"purpose of enforcement of
his responsibilities as such an official.

(f) The Community Development Program has been developed so as to give maxi-
mum feasible priority to activities which will benefit low- and moderate-income
families or aid in the prevention or elimination of slums or blight.
[The requirement for this certification will not preclude the Secretary from
approving an application where the applicant certifies, and the Secretary deter-
mines, that all or part of the Community Development Program activities are
designed to meet other community development needs having a particular urgency
as specifically explained in the application in accordance with S570.302(f).]
(g) It will comply with the regulations, policies, guidelines and require-
ments of OMS Circular No. A-l02, Revised, and Federal Management Circular 74-4
as they relate to the application, acceptance, and use of Federal. funds under
24 CFR 570.
(h) It will administer and enforce the labor standards reauirements set forth
in 24 CFR 570.605 and HUD regulations issued to implement such requirements.
(i) It will. comply with all requirements imposed by BUD concerning special
requirements of law, program requirements, and other administrative requirements,
approved in accordance with OM8 Circular No~ A-I02, Revised.
(j) It will comply with the provisions of Executive Order 11296, relating to
evaluation of flood hazards and Executive Order 11288 relating to the prevention,
control, and abatement of water pollution.
(k) It ~ill require every building or facility (other t~an a privately owned
residential structure) designed, constructed, or altered with funds provided
under 24 CFR 570 to comply with the "American Standard Specifications for Making
Bu ild ings and Facil i ties Access ible to, and Usable by, the Phys ically Hand icapp-
ed," Number A-ll7.l-R 1971, subject to the exceptions contained in 41 CFR 101-
19.604. The applicant will be responsible for conducting inspections to iniure
complian~e with these specifications by the contractor.
(1) It will comply with:
(1) Ti~le VI of the Civil Rights Act of 1964 (Pub. L. 88-352), and the regu-
lations issued pursuant thereto (24 'CFR Part 1), which provides that no person
in the United States shall on the grounds of race, color, or national origin, be
excluded from participation in, be denied the benefits of, or be otherwise sub-
jected to discrimination under any program or activity for which the applicant
receives Federal financial assistance and will immediately take any measures
necessary to effectuate this assurance. If any real property or structure there-
on is ~rovided or improved with the aid of Federal financial assistance extended
to the applicant, this assurance shall obLigate the applicant, or in the case of
any transfer of such property, any transferee, for the period during which the
real property or structure is used for a purpose for which the Federal financial
assistance is extended, or for another purpose involving the provision of similar
services or benefits.
(2) Title VIII of the Civil Rights Act of 1968 (Pub. L. 90-284), as amended,
administering all programs and activities relating to housing and community
development in a manner to affirmatively further fair housing~ and will take
ac.tion to affirmatively further fair housing in the sale or rental ,of housing,
the financing of housing, and the provision of brokerage services.
(3) Section 109 of the Housing and Community Development Act of 1974, and the
reaulations issued pursuant thereto (24 CFR Part 570.601), which provides that no
person in the United States shall, on the grounds of race, color, national origin,
or sex, be excluded from participation in, be denied the benefits of, or be sub-
jected to discrimination under, any program or activity funded in whole or in part
with funds ~rovided under 24 CFR 570.

(4) Executive Order 11063 on equal o~portunity in housing and nondiscrimina-
tion in the sale or rental of housing built with Federal assistance.
(5) Executive Order 11246, and the regulations issued pursuant thereto (24
CFR Part 130 and 41 CFR Chapter 60), and Section 4(b) of the Grant Agreement,
which ~rovides that no person shall be discriminated against on the basis of race,
color, reliqiQn, sex or national origin in all phases of employment during the
performance' of Federal or federally .ssisted construction contracts. Contractors
and subcontractors on Federal and federally assisted construction contracts shall
take affirmative action to insure fair treatment in employment, upgrading, demo-
tion, or transfer7 recruitment or recruitment advertising7 layoff or termination,
rates of payor other forms of compensation and selection for training and
,apprenticeship.
(m) It will comply with Section 3 of the Bousing.and Urban Development Act of
1968, as amended, requiring that to the greatest extent feasible opportuniti~s
for training and employment be given to lower-income residents of the project
area and contracts for work in connection with the project be awarded to eligible
business concerns which are located in, or owned in substantial part by, persons
residing in the area of the project.
(n) It will:
(1) To the greatest extent practicable under State law, comply with Sections
301 and 302 of Title III (Uniform Real Property Acquisition Policy) of the Uni-
form Relocation Assistance and Peal Property Acquisition Policies Act of 1970 and
will comply with Sections 3Q3 and 304 of Title III, and BUD implementing instruc-
tions at 24 CFR Part 427 and
(2) Inform affected persons of their rights and of the acquisition policies
and procedures set forth in the regulations at 24 CFR part_42 and S570.602(b).
(0) ~t will:
-(I) Comply with Title II (Uniform Relocation Assistance) of the Uniform Relo-
cation Assistance and Real Property Acquisition Policies Act of 1970 and BUD
implementing regulations at 24 CFR Part 42 and 5570.602(a)7
(2) Provide relocation payments and offer relocation assistance as described
in Section 205 of the Uniform Relocation Assistance Act to all persons displaced
as a result of acquisition of real property for an activity assisted under the
Community Development Block Grant program. Such payments and assistance shall be
provided in a'fair and consistent and equitable manner that insures that the
relocation process does not result in different or separate treatment of such
persons on account of race, color, religion, national origin, sex, or so~rce of
income7
(3) Assure that, within a reasonable period of time prior to displacement,
comparable decent, safe and sanitary replacement dwellings will be available to
all displaced families and individuals and that the range of choices available
to such persons will not vary on account of their race, color, religion, national
origin, sex, or source of income7 and
'(4) Inform affected persons of the relocation assistance, policies and proce-
dures set forth in the regulations at 24 CFR Part 42 and 24 CFR 570.602(a).
. (p). It will establish safeguards to prohibit employees from using positions
for a purpose that is or gives the appearance of being motivated by a desire for
orivate gain for themselves or others, particularly those with whom they have
family, business, or other ties.

(0) It will comply with the prOV1Slons of the Hatch Act which limits the
political activity of employees.
(r) It will give HUD and the Comptroller General through any authorized
representatives access to and the right to examine all records, book's, papers, or
documents related to the grant.
(s) It will insure that the facilities under its ownership, lease or supervi-
sion which shall be utilized in the accomplishment of the program are not listed
on the Environmental Protection.Agency's (EPA) list of Violating" Facilities and
that it will notify HUD of the receipt of any communication from the Director of
the EPA Office of Federal Activities indicating that a facility to be used in the
project is under donsideration for listing by the EPA.
(t) It will comply with the flood insurance purchase requirements of Section
102(a) of the Flood Disaster Protection Act of 1973. Pub. L. 93-234, 87 Stat.
975, approved December 31, 1973. Section 103(a) required, on and after March 2,
1974, the purchase of flood insurance in communities where such insurance is
available as a condition for the receipt of any Federal financial assistance for
construction or acquisition purposes for use in any area, that ha. been identi-
fied by the Secretary of the Department of Housing and Urban Development as an
area having special flood hazards. The phrase "Federal financial assistance"
includes any form of loan, grant, guaranty, insurance payment, rebate, subsidy,
disaster ass~stance loan or grant, or any other form of direct or indirect
Federal assistance.
(u) It will, in connection with its performance of environmental assessments
under the National Environmental policy Act of 1969, comply ~ith Section 106 of
the National Historic Preservation Act of 1966 (16 U.S.C. 470), Executive Order
11593, and the Preservation of Archeological and Historical Daia Act of 1966 (16
U.S.C. 469a-l, et. sea.) by:
(1) Consultinq with the State Historic Preservation Officer to identify
properties listed-in or eligible for inclusion in the National Register of His-
toric Places that are subject to adverse effects (see 36 CFR Part 800.8) by the
proposed activity, and
(2) complying with all requirements established by HUD to avoid or mitigate
adverse effects upon such properties.

Dear Mr. Lovell:
We have reviewed the above referenced application in
accordance with 36 C.F.R., Part 800 ("Procedures for the
Protection of Historic and Cultural PropertiesJ\) .as required
by federal regulations set forth in 24 C.F.R., Part 58 ("En-
vironmental Review Procedures for the Community Development
Block Grant Program") to determine whether or not the proposed
project described in the application will have any impact.
on archaeological or historical sites or properties listed,
or eligible for listing, on the National Register of Historic
Places, or which otherwise may be of national, state, or
local significance.
The authorities for these review procedures are .the
National Historic Preservation Act of 1966 (Pub11c Law 89-
665 as amended by P.L. 91-243, P.L. 93-54, P.L. 94-422, and
P.L. 94-458) and Presidential Executive Order 11593 ("Protection
and Enhancement of the Cultural Environment").
An examination of the Federal Register reveals no National
Register sites located in the vicinity of the project, but the
Florida Master Site File lists sites some of which may be National
Register eligible. After reviewing the project application, however,
it is the determination of this office that the project will
have no adverse impact on any archaeological or historical sites
or properties listed, or eligible for listing, on the National
Register of Historic Places, or which otherwise may be of national,
state, or local significance.

Subject: TBRPC Clearinghouse Review No. 218-78; Cormnunity Development Block
Grant Program-4th Year Entitlement, City of Clearwater
In accordan'ce with OMB Circular A-95 (revised), the Council staff has completed
its review of the above referenced Community Development Block Grant application
and offers the following recommendations and/or cormnent:
The proposal for a community development program including neighborhood housing
service program, utility and street improvements, drainage improvements, side-
walks and recreational facilities is regionally significant and is consistent
with the Tampa Bay Regional P1anni.ng Council's goals and objectives. The Future
of the Region, adopted by the Council in April, 1975 and amended in February,
1977 states that the Council encourages the development and expansion of programs
and facilities designed to increase the availability of decent housing to low and
moderate income households; and that it is the policy of the Council to ensure
that public and semi-public facilities are p~anned as an integr~ part of com-
munity development and redevelopment.
The application is well. prepared and reflects Clearwater's continued commitment
to meeting the various needs of the low and moderate income residents. The pro-
jects are logical extensions of community development efforts initiated in
previous community development planning pro:rrams, as well as. additional community
improvement activity proposed for related areas of need.
It is recommended that any renovation or expansion of the Clearwater drainage
system take into account water quality considerations. Drainage renovations
should be consistent with guidelines in the Areawide Water Quality Management
Plan and the supportive material contained in Appendix IlA: "Stormwater and
Lake Systems Maintenance and Design Guidelines..

Also, it is recommended that future City of Clearwater Community Development
Block Grant Applications place more emphasis on addressing housing improvement
needs. It is the opinion of the Council staff that a greater percentage of
CDBG proposals aimed at alleviating housing problems of the low and moderate
income residents IrOre fully reflects the intent of the Housing and Community
Development Act of 1974.
However, in summary, the Council staff does not find any significant inconsis-
tencies exhibited nor any noticeable conflicts with other surrounding jurisdic-
tional plans or goals as related to the city's Community Development proposal.
A copy of this letter should be appended to the application to indicate com-
pliance with areawide clearinghouse review requirements.

The application is well prepared and reflects Clearwater's continued commitment
to meeting the various needs of low and moderate income residents. The projects
are logical extensions of previous community development efforts as well as
similar community improvement activity in other areas of the city exhibiting the
greatest need.
The data used by the city to support the proposal appears to be the most current
and indepth that is available for the community. As presented in the application
and the HAP, the data reflects the prevailing housing conditions and acceptable
assistance needed for the city's lower income households in the Council staff's
judgment. The "expected to reside" and other goals of housing needs were based
on the city's interpretation of available data. The staff finds the figures
and activities proposed to be consistent with areawide goals.

Although the staff of the Council did not participate directly in the prepara-
tion of the application, contact has been maintained prior to and during the
application development.
Areawide housing and functional plans (e.g. water, sewer, solid waste~ trans-
portation, health, education, air quality, etc.) will not be any more impacted
than would be expected to occur in a grow~Dg urban community. No additional
services or community facilities not yet developed or planned were identified
by the staff to necessarily support the proposed housing goals established by
the city.
In summary, the Council staff does not find any significant inconsistencies
