RESOLUTION 79-117 I , CITX CLERK' RESOLUTION NO. 79 - 117 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA APPROVING A MODIFIED INTER LOCAL AGREEMENT ESTABLISH- ING THE PINELLAS COUNTY METROPOLITAN PLANNING ORGANIZA TION. WHEREAS, the Pinellas County Metropolitan Planning Organization was created and established by an interlocal agreement under Florida Statute 163.01, which was dated August 17, 1977:-Touperform transportation functions identified in Federal Laws Titled 23 U. S. C. and 49 U. S. C.; and WHEREAS, the State legislature enacted Florida Statutes Section 334.215 to define the Metropolitan Planning Organizations of Florida in State Law; and WHEREAS, this new Statute precipitates the need to have the Metropolitan Planning Organization established under an interlocal agreement which references Section 334.215 of Florida Statutes; and WHEREAS, a modified in1;.erlocal agre.ement has been developed which '. references said Statute. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. That the City Commission of the City of Clearwater, Florida, on behalf of the City of 'Clearwater, Florida, does hereby approve the modified interlocal agreement submitted to it establishing the Metropolitan Planning Organization, and agrees to be a member of such organization in conformance with the terms of such modified agreement. 2. That a copy of this Resolution shall be submitted to ~he office of the Governor and present members of the Metropolitan Planning Organization. 3. WIT N E SSE T H: WHEREAS, 'the PirteTlas COtnlty Planning COtnlcil has budgeted planning assistance funds to assist the municipalities of Pine lIas County in the development of detailed land use plans within the framework of the County Plan and in implementation of the Uniform Development Code; and WHEREAS, the municipality has applied and qualified for a grant under these funds; NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. The municipality, through its planning department, a qual- ified consulting firm, the planning department of a cooperating munici- pality, or thePinellas County Planning Department shall complete during the Council fiscal year 1978-1979 the planning task(s) described as follows: (a) Review of the capital improvement requirements outlined in the elements of Comprehensive Plan adopted or pending adoption under the Local Government Comprehensive Planning Act such plan horizon to be the year 2000 unless otherwise noted. (b) Allocation of these proposed capital expenditures to the responsible jurisdictions, including, but not limited to, those special purpose jurisdictions contemplated in plans promulgated by county or regional planning bodies. L;'-- ~ ~ _ _ ~"'Il I I (d) Projection of revenue expected to be generated by the City of Clearwater, and revenues accruing to the City during the plan horizon. Such projections shall include but not be limited to, tax base, utility tax, inter- governmental transfers, and fees for services. (e) Estimation of the expenditures required to operate and maintain the projected capital improvements, the operation of which shall be a function of the general operating budget of the City of Clearwater. (f) Balancing the projected revenues against projected capital and operating costs, and recommending ways to meet any projected deficit which may be revealed as a result of this study, 2. The estimated total direct municipal cost to complete the task(s) shown in Paragraph 1 above is $16,800, Direct municipal cost includes cost for labor, materials, graphics or outside services spent in completion of the task(s) that is materially identifiable with the cost of the task(s). 3, The council shall reimburse the municipality on a quarterly basis for 100 percent of the expenses incurred in performing said task(s) subject to a maximum reimbursement of $16,800, The Council shall make payment within the thirty (30) days following the receipt of proper invoice from the municipality. The municipality shall maintain complete records of time and materials expended in performing said task(s), 4. The planning assistance funds distributed to the municipality will be used to supplement the municipality's planning effort and will not be used to replace previously budgeted funds, 5. An annual audit may be required by the Council, 6, This contract shall terminate on September 30, 1979. Any costs incurred by the municipality prior to and including the termina- tion date shall be presented by the City of Clearwater to the Pinellas County Planning Council for reimbursement. The council agrees not to unreasonably withhold reimbursement of such costs. - 2 - .~ - -. -.
