I I AN AGREEMENT TO UTILIZE PINELLAS COUNTY PLANNING COUNCil MUNICIPAL PLANNING ASSISTANCE FUNDS TH I S AGREEMENT, made and entered into th is I,it day of ,{.e U-v-- -LJ 198JL, by and between the PINELLAS COUNTY PLANNING COUNCIL, hereinafter referred to as the Council and the City of Clearw8.ter , hereinafter referred to as the municipality. WIT N E SSE T H: WHEREAS, the Pinellas County Planning Council has budgeted funds to assist the municipalities of Pinellas County to prepare required or optional elements specified in the LGCPA of 1975, or to implement the Uniform Development Code if adopted; and WHEREAS, the municipality has applied for a grant of these funds; NOW, THEREFORE, the p~rties hereto do mutually agree as fo1.1ows: I. The municipality, through its planning department, a qualified planning consulting firm, the planning department of a cooperating municipality, or the Pinellas County Planning Department shall complete during the Council fiscal 1980-81 year the planning task(s) described as follows: See Attachment I 2. The estimated total direct municipal cost to complete the task(s) shown in Paragraph I above is $ 10,950 Direct municipal cost includes cost for labor, materials, graphics, printing, or outside services spent in completion of the task(s) that is i~mediately identifiable with cost of the task(s). The Council shall reimburse the municipality on a quarterly basis for 100% percent of the direct municipal costs incurred for performing said task(s) subject to a maximum reimbursement in any single fiscal year of $ 10.950 provided, however, that only those costs incurred after the date upon which this Agreement was made and entered as first referenced above shall be reimbursable and provided further, that printing costs which exceed 5 percent of the total cost of the task(s) will not be reimbursed. The Council shall make payment within thirty (30) days following the receipt of a proper invoice or invoices from the municipal ity. The municipality shall maintain complete records of time and materials expended in performing said task(s) and shall indicate the percent of task(s) completi~n and ability to complete said contract with each invoice. 4. The planning assistance funds distributed to the municipality will be used to supplement the municipality's planning effort and will not be used to replace previously budgeted funds. 5. An annual audit may be required by the Council. 6. All invoices applicable to this agreement must be submitted within 60 days of the end of the fi5cal year of this agreement. 7. This Agreement shall terminate upon the termination of the fiscal year" referenced in Paragraph I. Work tasks include evaluation, revision and coordination of existing zoning, subdivision, sign, annexation, and related land use regulations now in effect, Recommended land development regulations will be consistent with the City's compre- hensive plan, adopted pursuant to section l63-FS, Particular attention will be paid to the following topics: 1. New zoning districts, permitted categories of activity, and performance standards, 2. Energy conservation in site planning and solar access requirements. 3. Increasing the effectiveness of the Community Impact Statement as a decision-making tool. 4. Consideration of instituting a system of transferable development rights, 5. Flood plain zoning standards. 6. Provisions for upgrading existing mobile home parks to city standards. 7. Consideration of the systems and categories contained in the uniform development code prepared for the Pinellas County Planning Council. Consultant involvement will include the following phases: 1. Data collection, review of existing codes, interviews with affected persons, literature reVIew. 2. Data analysis, synthesis of inventory information. 3, Preparation of inventory/evaluation working paper, inclusive of specific recommendations for the City's land development code. 4. Discussion of inventory/evaluation working paper with city and other affected parties.. S. Drafting of the land use code. 6. Discussion of the draft code. #~ , . ~ I I 7, Preparation of the final code document. 8, Preliminary adoption of the code by the City Commission, 9. Referral of the code for reVIew by the Local Planning Agency. WORK TO BE COMPLETED UNDER THIS CONTRACT Funding from the Pinellas County Planning Council will be used as partial reimbursement for steps one through five above. The work products to be submitted will be the working paper outlined in step three (above) and the draft land use code, - 2 -
