AN AGREEMENT TO UTILIZE
PINELLAS PLANNING COUNCIL
LOCAL GOVERNMEN"r PLANNING ASSISTANCE FUNDS

THIS AGREEMENT, made and entered into this ~ day

1989, by and between the pinellas Planning Council, hereinafter
referred to as the COUNCIL, and the city of Clearwater, herein-
after referred to as the Local Government.
WITNESSETH:
WHEREAS, Section 10(3) (b) of Chapter 73-594, Laws of Florida, as
amended provides that all local governments comprehensive plans and
land development regulations shall be consistent with the Countywide
Comprehensive Plan; and
WHEREAS, Section 5(9) empowers the Pinellas Planning Council to
review each element of the Countywide Comprehensive Plan to assure
coordination with local goals and policies; and
WHEREAS, the Pinellas Planning Council has budgeted funds to
assist the local governments of Pinellas County in the review of
their comprehensive plan provisions and land development regulations
for purposes of achieving the consistency required by Chapter
73-594, Laws of Florida, as amended; and
WHEREAS, the local government has applied for a grant of these
funds.
NOW, THEREFORE, the parties hereto do mutually agree as follows:
1, The Local Government, through its planning department, a
qualified planning consultant firm or the planning department of a
cooperating government unit shall complete, during the Council's
fiscal 1989-90 year, the planning tasks described in the Scope of
Services attached as Attachment A to this Agreement.
2. The amount of grant monies available to the Local Government
to complete the task(s) referenced in paragraph 1 above is $12,000,
3, The Council shall reimburse the Local Government on a
quarterly basis for twenty-five (25) percent of the grant amount,
payable as set forth in the Scope of Services, The Council shall
make payment within thirty (30) days following the receipt of a
proper invoice or invoices from the Local Government. The local
government shall maintain complete records sufficient to verify that

the grant funds are expended for the purposes outlined in the Scope
of Services.

4. The Planning Assistance Funds distributed to the Local
Government will be used to supplement the
Local
Government's
planning effort and will not be used to replace previously budgeted
funds.
5. An annual audit may be required by the Council.
6. All invoices applicable to this Agreement must be submitted
within thirty (30) days of the end of the fiscal year of this
Agreement.
7. This Agreement shall terminate upon the termination of the
fiscal year referenced in paragraph 1.
IN WITNESS HEREOF, the parties hereto have caused this Agreement
to be executed on the day and year set out above.

ATTACHMENT IIAII
SCOPE OF SERVICES
PURPOSE
It shall be the purpose of this work program to evaluate and
establish the basis to achieve consistency between the city of
Clearwater Land Use Plan and the Countywide Future Land Use Plan and
their application through the city of Clearwater Land Development
Regulations.
The end product of this work program shall be a definitive list
of proposed amendments to the city of Clearwater Land Use Plan
element and Land Development Regulations or to the Countywide Future
Land use Plan to achieve consistency between the city of Clearwater
Land Use Plan and Land Development Regulations, and the Count:ywide
uLand Use Plan and accompanying policies and rules.
CONTENT
The content of the work program shall include the following
principal components:

II. Land Development Requlations
A, Roster of Land Development Regulations Inventory key

Classifications - Establish the manner and degree to
which the development regulations are consistent or
inconsistent with the local government and countywide
land use plan objectives and categories.
C, Reconciliation of Development Regulations to Achieve
Consistency Identify recommended adjustment of
development regulations to align with local government
and countywide plan classifications, and as they may be
proposed to be changed, so as to achieve consistency
with the Countywide Plan.
III, Summary Report
A, Summary List of Local Government Plan and Development
Regulation Amendments Establish a definitive roster
of plan and reguratory amendments required to achieve
consistency with the Countywide Plan, including
recommended timetable therefor. This roster may
include recommended amendment of Countywide Plan
categories, policies and rules to achieve consistency.

SCHEDULE AND WORK PRODUCT
This work program will be initiated during and completed within
the 1989-90 fiscal year, October 1, 1989 to september 30, 1990.
The timetable for completing the work program and providing
interim and final work products shall be as follows:
