PUBLIC SERVICE AGREEMENT
BY AND BETWEEN THE CITY OF CLEARWATER, FLORIDA AND
WESTCARE GULFCOAST - FLORIDA, INC.
THIS FIRST AMENDMENT TO CDBG PROGRAM AGREEMENT (this "First Amendment ") is made
and entered into by and between the City of Clearwater, Florida, a Florida municipal corporation, with a
principal address of P.O. Box 4748, Clearwater, Florida 33758 (the "City"), and Westcare Gulfcoast -
Florida, Inc., a Florida not-for-profit corporation, with a principal address of 1735 Dr. Martin Luther King
Jr. St. South, St. Petersburg, FL 33705 ("Subrecipient") (the City and Subrecipient shall be referred to
collectively as the "Parties").
WITNESSETH:
WHEREAS, the City administers a Community Development Block Grant ("CDBG") Public Services
Program, which is funded by the United States Department of Housing and Urban Development ("HUD");
and
' WHEREAS, the City submitted its Annual Action Plan (the "Action Plan") for the fiscal and program
year ending September 30, 2026 (FY2025-2026), as approved by the City of Clearwater City Council, to
HUD.
WHEREAS, The City is an entitlement community that receives CDBG funds awarded under the
Housing and Community Development Act of 1974, in furtherance of its goals of promoting Public Services,
Public Facilities and Improvements, and Housing Initiatives as further detailed in its Consolidated Plan for
Housing and Community Development Programs 2025 -2029; and
WHEREAS, Subrecipient is a not-for-profit organization that provides a comprehensive range of
services including counseling, case management, recovery -based programs, job support, and housing
assistance to help individuals achieve their personal goals and transform their lives; and
WHEREAS, the Parties entered into that certain CDBG Program Agreement dated February 10,
2026 (the "Agreement") to utilize TWENTY-THREE THOUSAND ONE HUNDRED FORTY-SEVEN DOLLARS
AND 00/100 CENTS ($23,147.00) in FY2025-2026 to utilize CDBG funds for Salary Support to operate it's
"A Turning Point" Program. This program aligns with the City of Clearwater's Consolidated Plan goals to
prevent and reduce homelessness. Subrecipient provides shelter and supportive services to chronically
homeless individuals with substance use disorders and/or mental health conditions and is designed to serve
approximately 100 unduplicated Clearwater residents during the program year; and
WHEREAS, these services are an eligible activity under the CDBG program in accordance with
24 CFR §570.201(e) Public Services and meet a national objective as required under 24 CFR
§570.208(a)(2) being that the services are activities benefiting low -and moderate -income persons as Low -
Mod Limited Clientele Activities (LMC) and 24 CFR §570.200(a); and
WHEREAS, Subrecipient has available the necessary qualified personnel, facilities, materials, and
supplies to perform such services and/or carry out such programs for these people, who are eligible and
qualified to receive said services and are within the income limits for low- and moderate -income persons

as defined by HUD and adjusted annually, and which current income levels are attached as Exhibit "A" and
incorporated herein by reference; and
WHEREAS, the Parties now wish to amend the Agreement to include fringe benefits for staff
performing CDBG-eligible activities; and
NOW THEREFORE, in consideration of the mutual covenants and agreements contained herein,
and for other good and valuable consideration, the sufficiency and receipt whereof being hereby
acknowledged, the City and Subrecipient agree as follows:
SECTION I: SCOPE OF SERVICES AND USE OF FUNDS
1. Recitals. The recitals set forth above are true and correct and are incorporated herein and made
a part of this First Amendment.
2. Amendment to Agreement. Section I, Paragraph 4. Of the Agreement is hereby amended as
follows to include fringe benefits and clarify reimbursement for eligible staff time and reporting of
Clearwater residents served to:
"The Subrecipient will utilize FY 2025-2026 CDBG funds to support salary costs and fringe
benefits for services performed under this Agreement for a CDBG—eligible activity, the "A
Turning Point". The program provides shelter and supportive services to chronically
homeless individuals with substance use disorders and/or mental health conditions (the
"Project"). Reimbursement includes eligible staff salary and associated fringe benefit for
documented time spent carrying out such activities, subject to CDBG requirements and
supporting payroll documentation. Reimbursement shall be based on documented eligible
staff time and associated fringe benefits in carrying out eligible CDBG activities"
Subrecipient shall submit monthly reports through the Neighborly Portal, which will include
the reporting of Clearwater residents served. Such reporting is required for program
compliance and beneficiary documentation purposes. Eligible costs shall include fringe
benefits associated with salary costs for staff performing CDBG-eligible activities under the
Agreement, provided that such fringe benefits are reasonable, necessary and properly
allocated to the CDBG-funded activity. Eligible fringe benefits, in accordance with program
policy to include sick leave, vacation leave, holiday leave employer -paid taxes (e.g. social
security) and employer -paid health, dental, vision, and life insurance contributions. All
fringe costs must be supported by corresponding payroll records and allocated based on
actual hours worked on eligible CDBG activities. The Project will benefit 100 low- to
moderate -income City of Clearwater residents according to HUD income guidelines
attached as Exhibit "A". Additional requirements for the Project are attached as Exhibit "C"
and made a part hereof by this reference. The budget, scope of work, and milestone for
this Project (the "Budget") is attached as Exhibit "D" and made a part hereof by reference.
3. Amendment to Exhibit "D". Exhibit "D" of the Agreement is hereby amended and restated as
follows:

Public Services:

Use of CDBG Funds:
• One (1) Full -Time Equivalent (FTE) Case Manager,
• One (1) Full -Time Equivalent (FTE) Peer Support Specialist
Case Manager Responsibilities - This position plays a critical part in supportingindividuals who are
undergoing treatment for substance use disorders.
• Provide individual, group, and family counseling services.
• Conduct screenings and assessments.
• Deliver crisis intervention and management.
• Coordinate referrals and linkage to appropriate housing, treatment, and supportive services.
• Support harm reduction strategies and recovery goals in collaboration with clients,
• Develop individualized action plans to address housing, recovery, and support needs.
• Monitor and evaluate client's
Peer Support Specialist Responsibilities - This position is someone that has direct live experience with
substance abuse and has exhibited success in sustaining a crime and drug-free life for a minimum of two (2)
consecutive years.
• Offer peer leadership and mentorship.
• Conduct outreach and advocacy for clients.
• Provide recovery coaching and support services.
• Assist clients in navigating treatment, housing, and supportive resources.
• Collaborate with case managers and other service providers to support client goals and service plans.
• Encourage client engagement in community-based support and recovery networks.
• Provide emotional support, •encouragement, and advocacy during times of crisis or transition.

• Support clients in navigating recovery pathways, including harm reduction and abstinence -based
approaches.
• Lead educational groups focused on life skills development and relapse prevention strategies.
• Assist clients in developing recovery capital by enhancing their coping skills, personal resilience, and
access to social, housing, and community supports that promote long-term recovery.

Beneficiaries assisted must reside within City of Clearwater limits
(Tax District CW, CWD, or CWDO) and household income must be at or below 80% AMI based on the CDBG
income limits in effect at the time assistance is provided."
4. In the event of conflict or ambiguity between the terms and provision of this First Amendment and
the Agreement, the term and provisions of the First Amendment shall control to the extent of any
such conflict or ambiguity.
5. All sections of the Agreement not expressly amended herein shall remain in full force and effect.
