SUMMARY
This rule will set forth the actual legal des-
cription of the coastal construction control line in
Pinellas County, Florida, and procedures to be followed to
construct seaward of the line.
WRITTEN STATEMENT OF THE
FACTS AND CIRCUMSTANCES JUSTIFYING THE RULE
In 1970 the Florida Legislature made the follow-
ing statements (Chapter 70-231, Laws of Florida):
1. The attraction of Florida's beautiful beaches
and shores account for a substantial portion of the State's
annual tourist trade.
2. Beach and shore erosion is a serious menace
to the economy and general welfare of the people of this
State.
3. Unguided development of these beaches and
shores coupled with uncontrolled erosive forces ar~desb~oying

If construction or excavation is ataowed to

involved and on neighboring beach and shore properties as

5. Preservation of our beaches and shores is
therefore a subject of great public interest and concern
which requires appropriate action by the Legislature to pre-
vent further loss to one of our greatest natural resources.
6. The greater public interest compels that
certain reasonable restrictions be placed upon the location
of coastal construction and excavation even though such con-
struction or excavation be located on privately held land.
The proposed rule will establish such reasonable
restrictions.

Local public hearings were held on the proposed
rule in Treasure Island on November 9, 1976, and in Indian
Rocks Beach on November 10, 1976, in accordance with the
provisions of Section 161.053(1), Florida Statutes. Notice
of the hearings were published in. the Florida Administrative
Weekly, Vol. 2, No. 43, on October 22, 1976, and published
in the St. Pete Times and the Tampa Tribune on Oc1:ober 26
and November 3, 1976. In addition, notice was mailed to
each property owner affected by the proposal.
Approximately 209 interested persons attended
the hearing, including individual property owners, attorneys,
and representatives of several groups. The majority favored
the establishment of a coastal construction control line but
not at the location as recommended.
The hearing officer has determined from the
testimony and evidence at the public hearings, for the pro-
tectionof upland properties and the control of erosion in
Pine11as County, it is necessary that a control line be
established as recommended by the Coastal ~nd Oceanographic
Engineering Department. The hearing officer, therefore,
recommends adoption of this rule.

1. 16B-26.ll Description of the Pinellas County
coastal construction control line. There is hereby estab-
lished pursuant to Section 161.053, Florida Statutes, a
coastal construction control line in Pinellas County,
Florida. The legal description of said line is attached
hereto.
2. This rule shall take effect 20 days after
filing with the Department of State or on the date that it
is duly recorded in the public records in the office of the
Clerk of the Circuit Court in and for Pinellas County,
together with each affected municipality, whichever is
later.
3. After this rule becomes effective no person,
firm, corporation, or governmental agency shall construct
any structure whatsoever seaward thereof, or perform any
actions as described in Section 161.053, Florida Statutes,
without obtaining a permit as described in said secttpn,

Florida Coastal Management Program
Enclosed please find a copy of the proposed draft of the Florida
Coastal Management Program. This proposed draft has been revised
substantially to comply with the requirements of the new Florida
Coastal Management Act of 1978, which was passed by the Legislature
last June.
The Florida Coastal Management Act of 1978 has had three major
effects on the program. First, the Act directed the Department
of Environmental Regulation (DER) to compile and submit a coastal
management program for federal approval. This is a clear require-
ment that we should complete a state Coastal Management Program.
Second, the Act provided some new direction for the program; it
directed that the program which we are to prepare and submit should
be based,with two exception~ only on existing statutes and exist-
ing rules. The Legislature expressed the clear feeling that the
state has adequate authority to manage coastal resources.
Finally, the Act authorizes DER to develop and adopt procedural
rules for the allocation of federal grant funds to local govern-
ments, and rules to establish a procedure for implementing the
sections of the state and federal programs dealing with the con-
sistency of federal actions. These are the only new authorities
provided in the Act.
The enclosed draft program has been revised to comply with these
requirements. It utilizes only existing authorities, and proposes
no new authorities, policies, permits, or regulations. I would
like to draw your attention in particular to the Summary (pp. i-x);
Chapter IV. Policies for Management of Coastal Resources and
Activities; and Chapter V. Program Authorities, Organization, and
Implementation.

Please note that this is only a draft which is being circulated
at this time for your review and comments. We expect that it
will be revised to reflect the comments received, and distributed
in a more final form in early 1979. The revised proposal will
be subject to public hearings as well as a Federal Environmental
Impact Statement; on both of these occasions we will again seek
your review and comment. Following any further changes, we hope
it will be formally submitted for federal approval in late Spring,
1979. Because the review and revisions will necessarily depend
upon the comments received, we do not at present have a definite
schedule for when the hearings or revisions can be expected.
