There are leaves and branches piled on the roof and weeds and trees are growing out of the gutters. In response to a question, Mr. Daniels said he has had no communication with the property owner. Member Ryan-Anderson moved to find the Respondent in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Ryan-Anderson moved to enter an order requiring the Respondent to correct the violations on or before June 1, 2026. If the Respondent does not comply within the time specified, the Board may order a fine of $150.00 per day per violation for each day each violation continues to exist. After 3 months from the recordation date of such lien, if the fines and fees remain unpaid, the City Attorney's office is authorized to foreclose, collect or settle such lien using any legal or equitable remedies available under the law. (Daniels) Case 75-26 was withdrawn. 3.9 Case 76-26 - Find respondent(s) Malize Enterprises Inc at 1004 S Martin Luther King, Jr. Ave. in violation of Code for Permits; and issue an order with the compliance deadline and fine if compliance is not met. (Reese) No one was present to represent the Respondent. Inspector Reese provided a PowerPoint presentation. She said a roof was installed without a permit, including framing and rafters, and a window was removed. After the initial inspection, it was discovered that interior work was being done without a permit as well. She said she has had contact with the property owner many times. The owner hires contractors then the contractors pull off the job. She said a permit application has been submitted but additional information and revisions are needed before the permit is issued. Member Plumb moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Plumb moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by May 22, 2026 and completing the permit in six months. If the Respondent does not comply within the time specified, the Board may order a fine of$150 per day per violation for each day each violation continues to exist. (Reese) No one was present to represent the Respondent. Inspector Reese provided a PowerPoint presentation. She said the parking lot surface was repaved and striped without a permit. The permit application referenced in the previous case includes the paving work. 4 City of Clearwater Municipal Code Enforcement Board Meeting Minutes April 22, 2026 Member Plumb moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Plumb moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by May 22, 2026 and completing the permit in six months. If the Respondent does not comply within the time specified, the Board may order a fine of$150 per day per violation for each day each violation continues to exist. After 3 months from the recordation date of such lien, if the fines and fees remain unpaid, the City Attorney's office is authorized to foreclose, collect, or settle such lien using any legal or equitable remedies available under the law. The motion was duly seconded and carried unanimously. 3.11 Case 78-26 - Find respondent(s) Aa Torres Pabon at 1450 Franklin St. in violation of Code for Permits; and issue an order with the compliance deadline and fine if compliance is not met. (Reese) No one was present to represent the Respondent. Inspector Reese provided a PowerPoint presentation. She said asphalt surfacing was done without a permit. She said the previous inspector had contact with the property owner who said they needed to get a property survey done before they could apply for the permit. Now the property owner does not agree that this is a violation. In response to a question, Ms. Reese said her last contact with the property owner was in December. Member Ryan-Anderson moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Ryan-Anderson moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by May 22, 2026 and completing the permit in six months. If the Respondent does not comply within the time specified, the Board may order a fine of $150 per day per violation for each day each violation continues to exist. (Reese) No one was present to represent the Respondent. Inspector Reese provided a PowerPoint presentation. A patio and balcony were screen enclosed without a permit. She said she has had contact with the tenant but not the owner. The tenant told Ms. Reese they were having financial issues and she gave them additional time to obtain a permit before she brought the case to the Board. In response to a question, Ms. Reese said the tenant told her they had advised the property owner of the issue but she has not had contact with them. Member Gird moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Gird moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by May 22, 2026 and completing the permit in six months. If the Respondent does not comply within the time specified, the Board may order a fine of$150 per day per violation for each day each violation continues to exist. (Reese) No one was present to represent the Respondent. Inspector Reese provided a PowerPoint presentation. There is a sign on each of the four exterior walls that were installed without permits. She said she has been in contact with the restaurant owner who understands what needs to be done. She said she spoke with the owner last week who said the sign company would be submitting a sign permit application, but nothing has happened since the phone call. Member Strickland moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Strickland moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by May 22, 2026 and completing the permit in six months. (Reese) 7 City of Clearwater Municipal Code Enforcement Board Meeting Minutes April 22, 2026 No one was present to represent the Respondent. Inspector Reese provided a PowerPoint presentation. She said the unit for this case is #308. An interior remodel was completed without a permit. She said a previous inspector opened the case and has pictures of open walls, drywall work, and electrical work. A permit was pulled in 2020 but it expired. She said that permit did not include electrical work. Member Plumb moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Plumb moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by May 22, 2026 and completing the permit in six months. (Ito) No one was present to represent the Respondent. Inspector Ito provided a PowerPoint presentation. An interior remodel, including electric and plumbing, was completed without a permit. He said the current owner and previous owner are working together to bring the property into compliance. Member Ryan-Anderson moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Member Ryan-Anderson moved to enter an order requiring the Respondent to correct the violations by obtaining a permit by June 24, 2026 and completing the permit in six months. If the Respondent does not comply within the time specified, the Board may order a fine of $150 per day per violation for each day each violation continues to exist. The motion was duly seconded and carried unanimously. 3.20Case 87-26 - Find respondent(s) Gratus Filius Enterprises LLC at 1700 Gulf to Bay Blvd. in violation of Code for Unsafe Building; and issue an order with the compliance deadline and fine if compliance is not met. (Larsen) Attorney Matt Blackshear, representing the landowner, and attorney James Wardell, representing the tenant, were present. Inspector Larsen provided a PowerPoint presentation. The lot is the future home of a coffee shop and is currently a construction site. The site appeared abandoned until recently, there were open trenches in the dirt, the silt fence was torn down, and piles of dirt are scattered around the property. Site work was done at the end of March and the structure is now open with exposed pipes. He said there is an active permit as of February 10, 2026. Mr. Blackshear said work started then abruptly stopped when issues with the contractor were discovered. It was a long process to find a new contractor and start the permitting again. Mr. Wardell said the tenant is anxious to get open and generate income. Building Official Kevin Garriott said this is an unusual case to present as there is an active permit for the project. He explained that there was a permit issued a couple years ago and the building has sat empty with no progress until the end of March. In response to a question, Mr. Larsen said the nuisance condition of the property is the violation. Discussion ensued with comments made that progress is being made and the case should be continued. Member Plumb moved to continue Case 87-26 to the July meeting. The motion was duly seconded and carried unanimously. 3.21 Case 88-26 - Find respondent(s) Alexander Gabriychyk & Snezhana Gabriychyk at 1623 Windsor PI. in violation of Code for Permits; and issue an order with the compliance deadline and fine if compliance is not met. An above ground pool was installed without a permit. She said she has been in contact with the tenant and has provided additional time to comply without progress. Member Plumb moved to find the Respondent was in violation of the City of Clearwater Code as referred to in the affidavit in this case. The motion was duly seconded and carried unanimously. Attorney for the Board Andy Salzman said the administrative and investigative costs for the case total $1,135.20. Member Ryan-Anderson moved to enter an order reducing the amount of the lien for Case 48-24 to administrative costs of$1,135.20, payable within 30 days or the lien will revert to its original amount. Nuisance Abatement Lien Filings 6.1 Case 92-25 - Accept the Nuisance Abatement Lien for respondent(s) Ibrahimbegovic, Edvina Tre at 1353 Lakeview Rd. for Inoperative Vehicle; and issue an order with the compliance deadline and authorize the City to mitigate the violation if compliance is not met. Member Ryan-Anderson moved to enter an order finding the Respondent in violation of the City of Clearwater Code and requiring the Respondent to correct the violations within five days of the Board's written order. If the Respondent does not comply within the time specified, the City may take all reasonable actions, including entry onto the property, to abate and maintain the nuisance, and charge the Respondent with the reasonable costs which will become a lien on the property. After 3 months from the recordation date of such lien, if the costs remain unpaid, the City Attorney's office is authorized to foreclose, collect or settle such lien using any legal or equitable remedies available under the law. The motion was duly seconded and carried unanimously. 6.2 Case 105-26 - Accept the Nuisance Abatement Lien for respondent(s) Lisa Upshur at 1610 N Madison Ave. for Inoperative Vehicle; and issue an order with the compliance deadline and authorize the City to mitigate the violation if compliance is not met. (Dixon) No one was present to represent the Respondent. Inspector Dixon provided a PowerPoint presentation. A vehicle in the driveway has flat tires and an expired tag. He said he spoke to the property owner who said the vehicle belongs to a family member who is out of town. Member Gird moved to enter an order finding the Respondent in violation of the City of Clearwater Code and requiring the Respondent to correct the violations within five days of the Board's written order. If the Respondent does not comply within the time specified, the City may take all reasonable actions, including entry onto the property, to abate and maintain the nuisance, and charge the Respondent with the reasonable costs which will become a lien on the property.
