Attached are copies of three HUD memoranda and a memo of July 9,
1985, from Assistant City Attorney Alan S. Zimmet.
Eight land acquisitions and one development were the City's
responsibility under the Federal Open Space Land Program, The
attachments state that these nine items are no longer subject
to HUD jurisdiction, neither are they subject to any Federal
regulations on their use or disposition.
The following parcels of land and facilities affected are:
1. McMullen Park (Edenville Road)
2. Turner Park (Hercules Avenue) --Frank Tack Park
3. North Greenwood Recreation Facility (Douglas Avenue)--Martin Luther
King Center
4, Kings Highway
5. Del Oro Groves (San Jose Street)--former Urshall Property

8. N. E. Coachman and Coachman eN. E. Coachman Road)

It is important that all City records reflect the change in these
Federal regulations.

I have reviewed the HUD memoranda regarding changes in the Open-Space
Land Program P9 agi'ee that the 1983 Housing and Urban-Rural Recovery Act
exempts the nine City parcels from any Federal regulations on their use or disposition.
Research indicates that S 704 of Title VB of the Housing Act of 1961,
requiring prior approval for conversion of open space, was indeed completely repealed
by S 126(bX3) of Title I of the 1983 Housing and Urban-Rural Recovery Act.
Moreover, since authority to issue grants for new open-space projects under the 1961
act was terminated January 1, 1975, by S 116(a) of Title I of the Housing and
Community Development Act of 1974, the 1983 repeal applies to all existing open-
space sites.
Furthermore, prior Federal discretion regarding open-space sites does not
rise to the level of a vested rightgenerany protected from subsequent legislative
enactments. Vested rights disputes arise from the fact that private expectations for
development are thwarted by changes in public regulations.
