ARTIFICIAL REEF CONTRACT AND AGREEMENT f. , I I CONTRACT AND AGREEM.ENT THIS AGREEMEl'--J"T, dated this _l,.8th day of December, 1972, by and between the Department of Natural Resources, Division of Recreation and Parks, hereinafter referred to as the DEPARTMENT', and the City of Clearwater, hereinafter referred to as the CITY, WIT N E SSE T H: That in and for the mutual covenants between the DEPARTM.ENT and the CITY, it is agreed as follows: 1. The DEPARTMENT has found recreation to be the prime purpose of this project and has agreed to enter into a contract with the CITY for construction of an artificial reef approx- imately three and eight-tenths miles (3.8) off-shore from Clearwater Beach in the waters of the Gulf of Mexico, such location more specifically described in Exhibit A attached. 2. The DEPARTMENT agrees to contribute the sum of FORTY.- EIGHT THOUSAND TWO HUNDRED DOLLARS ($48,200.00), to be paid from the Land Acquisition Trust Fund, and to be used specifically for the construction of said Clearwater artificial reef. All funds to be contributed by the DEPARTMENT will remain on deposit in the Land Acquisition Trust Fund and will be released, upon appropriate billing, after satisfdctory completion or work. 3. The CITY agrees to cause construction of said artificial reef, such construction being in accordance with the project development plans and specifications, which, by reference hereto, are made a part of this agreement. The CITY further agrees to cause construction of a self-propelled barge to be used for the said artificial reef construction. Said barge I ".' ,. i\ II Lf C) () f I,..i '../ ....., I' I shall be constructed so as to conform to the specifications, attached hereto as Exhibit B. 4. ~he CITY agrees to take title to said self-propelled I barge for the entire project period and furUler agrees to transfer title to the Department of Natural Resources, Division of Rec~ation and Parks at the end of the entire project period as stated in Item 8. 5. The CITY agrees to insure said self-propelled barge for an amount equal to the construction cost of said barge and further agrees to maintain the barge in good condition for the entire project period. 6. The CITY agrees to be responsible for contract administration, supervision of construction and certification of satisfactory completion of work for the construction of said a~tificial reef. 7. The CITY agrees to provide any and all maintenance needed to insure the continued use of said artificial reef at its own expense and covenants that it has the full legal authority and financial ability to so operate and maintain said facility. 8~ The CITY agrees to undertake construction of said artificial reef within three (3) months from this date and further agrees to complete said artificial reef within fifteen . . , (15) months from the starting date of construction. 9. The CITY agrees to provide the DEPARTMENT with a progress report at least every sixty (60) days from this date until construction is certified complete. This report shall include a detailed inventory of all reef materials put In place. 10. The CITY agrees to appoint a liaison agent to be responsible for progress reports to be made to the DEPARTMENT -2- I' I as stated in Item 9. 11. The' DEPARTMEtJ"T shall have the ,right to inspect the site, as well as the right to audit the financial records pertaining to this project, at all reasonable times. All deck, bottom, sides and bulkheads must be at . 'least 3/16" thick steel plate. Longitudinal bulkheads must be of solid 3/15" plate and be on no less than 318" centers. Cross bulkheads must be on no less than 610" centers and be welded water tight and on both side.; of plate. ~his makes for six water tight compartments across the hull. 1 1/211 X 1 1/2" X 1/4" angle iron bracing frames to be placed on 310" centers bet'ween each Cl'0$6 bulkhead. This will require six angle iron bracing fra.mes. Sach \vater tight compartment shall be tested either hydraulically or by air for leaks and shall have.2" and 4" access pipe nipples for pumping and inspection. This will make a total of twelve access water tight inspecti.on holes. Four bittsare . requested, one at . each COrnel" of the work barge with suitable reinforcing plate for tie-up. Hull to draw approximately 7" when work barge is empty and approximately 16" when hull is loaded with 25, 000 pounds. When loaded .. --~-with 25,000 - 30, 000 pounds, there must be at least .181'- 2011 free board v.....:above the water line. After fabrication and before deck plate is installed, one coat. of red lead primer shall be applied to all inside areas including bottom -of deck plate. After deck plate is installed, the outside surfaces shall .recei ve one coat of red lead primer before shipment. F.our suitable lifting. lugs shall be provided~ primarily welded to . :the sides or four corners of the work barge. . The minimum dimensions for the over-all work boat shall be at .... .'" .......Jeast 15' wide X 361 long, with raked bow and square transom from top to bottom. Design and construction prints to be provi.ded for approval three days after receipt of purchase order.
